APPROVAL OF MINUTES

March 18, 2021 Zoning Board of Appeals Meeting Minutes TMP-1340 Attachments: 031821 Minutes

A motion was made by Bob Nachtrieb, seconded by Jim Riggs, to approve March 18, 2021 Zoning Board of Appeals Meeting Minutes. The motion carried by the following vote:

Aye: Hennessy, Alessio, Nachtrieb, Riggs, Safford and Roehr

Please note speakers who engage in conduct injurious to the harmony of the Zoning Board of Appeals shall be called to order by the Presiding Officer and may forfeit the opportunity to speak.

During the Public Hearing, members of the public will be allowed to present evidence and ask questions subject to the rules of the meeting.

NEW BUSINESS: PUBLIC HEARING

PETITION 2021-15: A Special Use Permit to allow large diesel truck (no semi) repair, located at 100 McDonald Avenue

Mr. Jim Torri read the staff report into the record. Chairman Hennessy swore in Mark Koenig, 1205 Highland Avenue, Joliet, IL. and Taylor _____ Willowbrook, IL. Mr. Koenig spoke on behalf of the petition. Chairman Hennessy asked if any one would like to speak on behalf of this petition. No one came forward.

A motion was made by Jim Riggs, seconded by Vincent Alessio, to approve PETITION 2021-15: A Special Use Permit to allow large diesel truck (no semi) repair, located at 100 McDonald Avenue with the following conditions:

1. That no semi-trucks shall be repaired at this facility;

2. That no outside storage of customer vehicles shall be allowed on the landscaped area long McDonald Street, including the City parkway;

3. That no outside storage of customer vehicles shall be allowed on the City streets;

4. Temporary outdoor storage of vehicles awaiting to be serviced or to be picked up shall be limited to ten (10) days;

5. No temporary or long-term outdoor storage of inoperable vehicles, boats, recreational vehicles, or parts (including tires) shall be permitted;

6. That off-street parking shall remain in the future;

7. That a City Business License be secured prior to opening;

8. That the Special Use granted shall herein terminate and lapse unless a building permit or certificate of occupancy is obtained not later than 180 days of the effective date of this ordinance and the erection or alteration of a building is started or the use is commenced within such period. The Board may grant an extension of this period, valid for no more than one hundred and eighty (180) additional days, upon written application and good cause shown without notice or hearing. Whether or not there is an intention to abandon the Special Use, if any special use is discontinued for a continuous period of one year, or if an intent to abandon the Special Use is evident in a shorter period of time, the Special Use for such use shall become void, and such use shall not thereafter be reestablished unless a new Special Use Permit is obtained; and

9. Failure to comply with any of the above conditions could result in a rehearing and a possible revocation of the Special Use Permit.

The motion carried by the following vote:

PETITION 2021-16: A Variation on front and side yard setbacks to allow a second-floor addition to an existing 1.5 story home, located at 1000 N. Center Street.

Mr. Jim Torri read the staff report into the record. Chairman Hennessy swore in Armando Cervantes, 1000 N. Center Street, Joliet, IL. Mr. Cervantes explained that he is trying to improve his property after it was damaged by a fire. Mr. Nachtrieb asked what will be upstairs, Mr. Cervantes said three bedrooms and two bathrooms. Mr. Nachtrieb asked if there will be a kitchen, Mr. Cervantes said no. Chairman Hennessy asked if anyone else would like to speak on behalf of the petition. No one came forward.

A motion was made by Colette Safford, seconded by Vincent Alessio, to approve PETITION 2021-16: A Variation on front and side yard setbacks to allow a second-floor addition to an existing 1.5 story home, located at 1000 N. Center Street with the following conditions:

1. That the sidewalk along Moran Street shall be repaired prior to the issuance of a certificate of occupancy. The City, upon mutual agreement, shall allow an extension of this time frame if the property has been accepted into the 50 / 50 sidewalk replacement program.

2. That a building permit shall be obtained prior to construction. The motion carried by the following vote:

PETITION 2021-17: A Variation on signage to allow non-illuminated signs that do not face a public way, located at 116 N. Larkin Avenue

Mr. Jim Torri read the staff report into the record. Chairman Hennessy asked if the petitioner was present, they were not. Mr. Nachtrieb asked Mr. Torri asked if the new signage exceeds the limit for total signage, Mr. Torri said no. Chairman Hennessy asked if any one else would like to speak on behalf of this petition. No one came forward.

A motion was made by Bob Nachtrieb, seconded by Brigette Roehr, to approve PETITION 2021-17: A Variation on signage to allow non-illuminated signs that do not face a public way, located at 116 N. Larkin Avenue. The motion carried by the following vote:

Aye: Hennessy, Alessio, Nachtrieb, Riggs, Safford and Roehr

PETITION 2021-18: A Variation to increase maximum size of parking signage, located at 1023 E. Laraway Road.

Mr. Jim Torri read the staff report into the record. Chairman Hennessy swore in Howey ____, 700 Westridge, Joliet, IL. Mr. _____ came in to answer questions about the petition. Chairman Hennessy asked if any one would like to speak on behalf of this petition. No one came forward.

A motion was made by Jim Riggs, seconded by Brigette Roehr, to approve PETITION 2021-18: A Variation to increase maximum size of parking signage, located at 1023 E. Laraway Road. The motion carried by the following vote:

Aye: Hennessy, Alessio, Nachtrieb, Riggs, Safford and Roehr

PETITION 2021-19: A Special Use Permit for a vehicle charging, service, and repair facility, located at 2951 Mound Road.

This petition was tabled to the May 20th, 2021 Zoning Board of Appeals meeting by the Petitioner.

A motion was made by Bob Nachtrieb, seconded by Jim Riggs, to table PETITION 2021-19: A Special Use Permit for a vehicle charging, service, and repair facility, located at 2951 Mound Road. The motion carried by the following vote:

PETITION 2021-20: A Special Use Permit for truck and trailer parking, located at 2951 Mound Road.

Mr. Jim Torri read the staff report into the record. Chairman Hennessy swore in Nate Washburn, 111 N. Ottawa Street, Joliet, IL. Mr. Washburn came in support of this petition. Mr. Washburn gave a detailed overview of the proposed project. The board members and Mr. Washburn discussed the previous use as a landfill. Mr. Washburn explained there was confusion about all of the aspects of petition 2021-19 so it was tabled to clear things up. Chairman Hennessy asked if any one would like to speak on behalf of this petition. No one came forward.

A motion was made by Bob Nachtrieb, seconded by Jim Riggs, to approve PETITION 2021-20: A Special Use Permit for truck and trailer parking, located at 2951 Mound Road with the following conditions:

1. That the development will be subject to the City’s Payment In-Lieu-Of-Taxes (PILOT) fee;

2. That a site plan and landscaping plan shall be submitted and approved by staff as part of the future building permit application process;

3. That a City Business License be secured prior to opening;

4. That the Special Use granted shall herein terminate and lapse unless a building permit or certificate of occupancy is obtained not later than 180 days of the effective date of this ordinance and the erection or alteration of a building is started or the use is commenced within such period. The Board may grant an extension of this period, valid for no more than one hundred and eighty (180) additional days, upon written application and good cause shown without notice or hearing. Whether or not there is an intention to abandon the Special Use, if any special use is discontinued for a continuous period of one year, or if an intent to abandon the Special Use is evident in a shorter period of time, the Special Use for such use shall become void, and such use shall not thereafter be reestablished unless a new Special Use Permit is obtained; and

5. Failure to comply with any of the above conditions could result in a rehearing and a possible revocation of the Special Use Permit.

PETITION 2021-21: A Special Use Permit for truck equipment and sales, service and repair, located at 2951 Mound Road

Mr. Jim Torri read the staff report into the record. Chairman Hennessy swore in Nate Washburn, 111 N. Ottawa Street, Joliet, IL. Mr. Washburn appeared in support of this petition. Mr. Washburn explained Navistar International will be the proposed tenant at this facility. Chairman Hennessy asked if any one would like to speak on behalf of this petition. No one came forward.

A motion was made by Jim Riggs, seconded by Bob Nachtrieb, to approve PETITION 2021-21: A Special Use Permit for truck equipment and sales, service and repair, located at 2951 Mound Road with the following conditions:

1. That a site plan and landscaping plan shall be submitted and approved by staff as part of the future building permit application process;

2. That architectural plans shall be submitted and approved by staff, to ensure compliance with the City’s Non-Residential Design Standards, as part of the future building permit application process;

3. That a City Business License be secured prior to opening;

4. That the Special Use granted shall herein terminate and lapse unless a building permit or certificate of occupancy is obtained not later than 180 days of the effective date of this ordinance and the erection or alteration of a building is started or the use is commenced within such period. The Board may grant an extension of this period, valid for no more than one hundred and eighty (180) additional days, upon written application and good cause shown without notice or hearing. Whether or not there is an intention to abandon the Special Use, if any special use is discontinued for a continuous period of one year, or if an intent to abandon the Special Use is evident in a shorter period of time, the Special Use for such use shall become void, and such use shall not thereafter be reestablished unless a new Special Use Permit is obtained; and
