1. Discussion Re: Burning Ordinance

(Discussion) Mr. Moustis stated there are several large manufactured home parks in my district with homes are very close together. We never addressed burning pits in this type of community and I am getting complaints. Some feel there are safety issues and we should have discussed burning in manufactured home parks and trailer parks and we should revisit this. This has come to the attention of Land Use, prior to my asking. There is no water source for fire hydrants, it is a tanker district. The homes are very close together and if one catches on fire, usually more than one burns. This from a fire safety issue. I have not talked to the fire district, but we should get their input. We define what they can burn, but other things are being burned.

Mrs. Tatroe stated these are recreational fires and we define what they can burn; logs, sticks and charcoal bricks. That does not mean people do not burn other things; but it is very difficult to catch them.

Mr. Fricilone asked are there setbacks for recreational fires?

Mr. Tim Anderson replied it is 15 feet from neighboring structures. In this area there is only 18 feet between the homes. That is the concern of the resident complaining, he is dealing with embers when logs are added to the fire pit and he gets a lot of smoke because he is only 15 feet away. Smoke getting into the windows is another issue. I met with the resident. The owner moved the pit a little and met the 15 feet criteria from all neighboring structures. There is no criteria regarding your own structure.

Mr. Maher asked is this a covered pit? Could we require some type of wire covering?

Mr. Anderson replied there is nothing requiring covered pits.

Mr. Fricilone asked when he moved the pit to be 15 feet from the neighbors’ home how far away was he from his home?

Mr. Anderson replied less than 3 feet.

Mr. Fricilone stated we should require it to be 15 feet from every structure.

Mr. Anderson stated there are town homes in the unincorporated areas, If a person has a deck you may not be able to get 15 feet away.

Mr. Moustis asked can we look specifically at manufactured home parks? Do these parks have different zoning?

Mr. Anderson responded it is not a zoning issue; it is what you would like to see. My personally opinion is setbacks from any structure, including your own. Property lines are not an issue, because this is one large property.

Mr. Moustis stated the fire department has had issues with water, because there is no water source in the area. They have flushing hydrants, a big tank for their water and no public water or sewer system. My recommendation is 20 feet from all structures and that will cover the manufactured home parks.

Mr. Moustis asked Land Use to craft language for us to look at to address burning in manufactured home parks; 20 feet from all structures is reasonable. We should add all pits should be covered with wire mesh to prevent embers from leaving the property.

Mrs. Ogalla stated the 20 feet requirement will eliminate burning in most mobile home communities.

Mr. Tuminello asked will this be tied to a specific zoning classification?

Mr. Moustis stated if there is a separate zoning classification for mobile home parks with a SUP; or we could say in mobile home parks. My initial thought was to eliminate it in certain zoning classifications.

Mrs. Tatroe stated this particular complaint came from the Gateway Community. The County Board did not approve the zoning, it was went to court and was court ordered to allow the development. I would have to review the court order to see how we could craft the Ordinance based on the zoning.

Mr. Moustis stated the court order allowed them to do a manufactured home park. It was a zoning case they sued over. We had to grant them zoning for the manufactured home park.

Mrs. Tatroe stated I think the court allowed the development. The court does not have the authority to order County Board to allow the zoning, but you are prohibited from enforcing the zoning ordinance. I will look at the history of the development.

Mr. Dubois stated we will discuss these ideas at Committee and come up with options for the State’s Attorney’s Office to review.

Mr. Moustis asked Land Use to get comments from the fire department and come back with suggestions whether they feel this is a safety issue.

Mrs. Ogalla asked could the mobile home park ban burning?

Mr. Moustis stated that would be the common sense thing to do. Have the people who own the property say you cannot have recreational fires three feet from structures. They indicated, if we do it, they will enforce it.
