Village of Manhattan Board of Trustees met March 6.

Here is the minutes provided by the Board:

A Regular Meeting of the Village of Manhattan President and Board of Trustees was held on Tuesday March 6, 2018. Mayor Doyle opens the meeting at 7:00 p.m. Roll call: Trustee Beemsterboer aye, Trustee Reeves aye, Trustee Biscan aye, Trustee Doyle aye, Trustee Naughton aye. Trustee McDonough is absent. Also present are Becker, Doyle, Kendall, Nelson, Pintar, Sing, Taylor, Tyk and Wazny.

Biscan motion to Open The Public Hearing For An Ordinance Authorizing The Execution Of An Annexation Agreement Between The Village Of Manhattan And First Midwest Bank, As Trustee For Successor Trustee Under The Provisions Of a Deed Or Deeds In Trust Duly Recorded and Delivered To Said Bank Pursuant To A Trust Agreement Dated May 18th, 1990 And Known As Trust Number 5446 (Pascale) (P.I.N 14-12-17-100-019-0000). Doyle second. Roll call: Beemsterboer aye, Reeves aye, Biscan aye, Doyle aye, Naughton aye. (5 ayes, 0 nays, 1 absent). Motion Carried.

Trustee McDonough arrives at 7:02 p.m.

Community Development Director Nelson informs the Mayor and Board of Trustees that they have before them An Ordinance Authorizing The Execution of An Annexation Agreement with Joe Pascal, Ordinance Annexing The Pascale Property and An Ordinance Rezoning the Pascale Property from ER Estate Residential to C-3 General Commercial District. The Village of Manhattan received a Grant from the State of Illinois for the reconstruction of the Smith/Gougar/Route 52 Intersection. The project will close Gougar Road of at U.S. 52 and realign it south of the existing intersection. The new section of Gougar Road will turn towards Route 52 just North of the bike path and cut through the Pascale Property. Mr. Pascale has agreed to dedicate the roadway to the Village and also Annex his property. When a property is annexed into the Village it is automatically zoned ER Estate Residential. The Planning and Zoning Commission held a Public Hearing to rezone the property to C-3 General Commercial District which will provide new future commercial opportunities for the Village at the new intersection and along Route 52. As part of the Annexation Agreement, the properties needed for the Gougar Road realignment will be dedicated to the Village. Some of the specific provisions of the Agreement are, Continuation of current farming and storage uses is allowed, Drive through restaurants and restaurants serving alcohol will be a permitted use provided all state and local laws are followed, Village Will abate its portion of taxes to the current owner, which will cease with the sale of the property or change of current use, and owner may de-annex in the event the Gougar Road realignment is not commenced within 24 months of this agreement and is not open to traffic within 6 months after. At this time there are no questions by the Mayor and Board of Trustees, and no questions from the Public that is present,

Village Administrator Sing informs the Mayor and Board of Trustees that the auditors in their report compared the financial condition of the Village with 4 surrounding communities. Village Administrator Sing points out that the comparison shows that the Village allocations are for The Public Safety Department and Public Works, which shows that the Village is committed to frontline funding for the safety of residents and community.

Assistant Finance Director Kendall informs the Mayor and Board of Trustees that they have before them the Final Draft of the 2018-2019 Budget. The Village is required to hold A Public Hearing on its annual budget to allow the Public the ability to provide input. Assistant Finance Director Kendall informs everyone that the Village for the 12th Consecutive Year has received the Certificate of Achievement for Financial Reporting. Assistant Finance Director Kendall reviews a brief summary on our current financial condition along with the projections for the 2018-2019 Fiscal Year. At this time there are no questions by the Mayor and Board of Trustees, and no questions from the Public that is present,

Under Public Comments resident and Member of the Manhattan VFW Post #935, Gus Baseleon hands out a to the Mayor and Board of Trustees a Flier inviting everyone to the Manhattan American Legion Post #935 to a Meet and Greet that they will be hosting for the Veterans and active Military Personnel, and family members. The event will be on March 15th, at 6:00 P.M. to 9:00 P.M., at the Manhattan Township Building, 230 S. Wabash Street in Manhattan. There will be many organizations in attendance to provide information and answer questions.

Resident Cherie Galle is a concern citizen and does not want North Point. Cherie Galle feels that it is this Board’s responsibility to fight for its citizens against this development and the Village of Elwood. Cherie Galle states that the Village Boards only choice is to file a law suit against Elwood. That all of the residents in the community will support using tax dollars to file the law suit. The suit will then show Elwood that the Village Board is fighting for their residents and are standing up to say No to North Point.

Village Administrator Sing informs the Mayor and Board of Trustees that they have before them An Ordinance Amending Qualifications of Full-Time Officers In The Village Of Manhattan, Will County, State Of Illinois, First Read. The hiring of Full-Time police officers falls under the jurisdiction of the Manhattan Police Commission. In 2017, the Village set hiring standards for Police Officers. This Ordinance amends the maximum age from 34 to 35 years of age to mirror the Municipal Code’s maximum age. The remaining Standards will remain the same.

Naughton motion to Approve Waiving The First Read of An Ordinance Amending Qualifications of Full- Time Officers In The Village Of Manhattan, Will County, State Of Illinois. Beemsterboer second. Roll call: Naughton aye, Beemsterboer aye, McDonough aye, Reeves aye, Biscan ay, Doyle aye.

Village Administrator Sing informs the Mayor and Board of Trustees that they have before them Approval of State Street Auto Invoices Totaling $50.00. Trustee Doyle is the owner of State Street Auto, for the Village to continue using State Street Auto; we followed the Illinois Municipal Code which sets parameters for doing business with elected officials. The Village Executed the final Contract not to exceed $2,000 annually with State Street Auto. If approved the total expended under the extended contract is $1,240.50.

Naughton motion to approve the State Street Auto Invoices Totaling $50.00. Beemsterboer second. Roll call: McDonough aye, Reeves aye, Biscan aye, Doyle abstains because of the Personal Interest He Has in State Street Auto Naughton aye, Beemsterboer aye. (5 ayes, 0 nays, 1 abstain, 0 absent). Motion Carried.

Village Administrator Sing informs everyone present that the Mayor and Trustee Beemsterboer were in Springfield to work on Legislation for the Village’s cause, but had they had to inform State Representative Larry Walsh Jr., that as a community they could not support the Bill that he was putting forward. The Bill that State Representative Larry Walsh, is trying to put forward would cripple the Village for commercial development, as well as other Illinois communities. The Bill would require a Two (2) year waiting period after annexation of property, commercial developers will not want to put their developments off for Two (2) years. Mayor Doyle and Trustee Beemsterboer point out that the other Illinois Representatives were also not in support of this Bill, and they all feel that it will fail. They both point out that it is a good effort, but just will not work, but they are still working together to find a solution.

Assistant Finance Director Kendall informs the Mayor and Board of Trustees that they have before them An Ordinance Adopting The Fiscal Year 2018-2019 (May 1, 2018-April 30, 2019) Budget In Lieu Of Passage Of An Appropriation Ordinance. Assistant Finance Director Kendall points out that the only change since presenting the Draft Budget is the New Waste Management Program.

McDonough motion to Approve An Ordinance Adopting The Fiscal Year 2018-2019 (May 1, 2018-April 30, 2019) Budget In Lieu Of Passage Of An Appropriation Ordinance. Doyle second. Roll call: Reeves aye, Biscan aye, Doyle aye, Naughton aye, Beemsterboer aye, McDonough aye. (6 ayes, 0 nays, 0 absent). Motion Carried.

Public Works Supervisor Tyk informs the Mayor and Board of Trustees that they have before them the 2018 Annual Street Projects for re-surfacing, curb and gutter repairs, structure adjustment, and sidewalk repairs. Other work that will be done will be storm structure adjustments, curb and sidewalk repair and street re-stripping. The Mayor and Board of Trustees have no added projects at this time.

Village Clerk Becker informs the Mayor and Board of Trustees that each of them should have received from Will County Clerk’s Office a letter directing them on how to file their Economic Interested on line. If anyone is having a problem or cannot do it on line, please let Village Clerk Becker know and she will get them a paper copy to file.

Mayor Doyle recommends the Re-Appointment of Robert Dykstra to the Police and Fire Commission.

Beemsterboer motion to Approve The Re-Appointment Of Robert Dykstra To The Police And Fire Commission For A Term Expiring March 2021. Doyle Second. Roll Call: Doyle aye, Naughton aye, Beemsterboer aye, McDonough ay, Reeves aye, Biscan aye. (6 ayes, 0 nays, 0 absent). Motion Carried.

Mayor Doyle informs everyone present that a Letter of Default was sent to the Village of Elwood and their reply was that they are not in violation of the Boundary Agreement.

Trustee McDonough wants to Thank the Irish Fest Committee, the Police Department, and EMA for doing a great job and for keeping the event under control.

Trustee Doyle wants to Thank Public Works for setting up and cleaning up after Irish Fest, and also Thank the Police Department and EMA. Trustee Doyle points out that the Signs that EMA Director Doyle obtained were great.

Trustee Beemsterboer also would like to Thank Public Works Staff, the Police Department and EMA for all they did, as well as Mother Nature the weather was really nice for the event.

Trustee Naughton would like to Echo the Thanks to all the Staff, as well as say Thank to the Irish Fest Committee for bringing in the Street Sweeper on Monday it was a much better idea then right after the Parade.

Trustee Biscan wants to Echo what the other members have said, everyone did a great job.

Trustee Reeves also wants to Thank Public Works, the Police Department, EMA and Village Clerk Becker for driving in the parade.

Mayor Doyle wants to Thank everyone that attended the meeting tonight, and he wants them to know that they do take their concerns under consideration.

McDonough motion to adjourn the Regular Meeting at 7:54 p.m. Doyle second. All members are in favor.
