Village of Frankfort Board of Trustees met June 17.

CALL TO ORDER & ROLL CALL

Mayor Keith Ogle called the regular meeting of the Frankfort Village Board to order on Monday, June 17, 2024, at 7:01 P.M., at the Village Administration Building, 432 W. Nebraska Street, Frankfort, Illinois.

Village Clerk Katie Schubert called the roll. In attendance were Mayor Keith Ogle, Clerk Katie Schubert, Trustees Adam Borrelli, Michael Leddin, Jessica Petrow, Maura Rigoni, Dan Rossi, and Gene Savaria. Also in attendance were Attorney Hannah Lamore, Village Administrator Rob Piscia, Assistant Administrator John Burica, and Police Chief Leanne Chelepis.

PLEDGE OF ALLEGIANCE

Mayor Ogle led the Pledge of Allegiance to the Flag.

APPROVAL OF SPECIAL ORDERS - UNANIMOUS CONSENT AGENDA

All items on the Omnibus Agenda are considered to be routine in nature and are enacted in one motion. There is no separate discussion of these items unless a board member makes a request, in which event, the item will be removed from the Consent Agenda and will be considered separately.

C. Committee of the Whole Report

1. Liquor Code Amendment: Chapter 113 - Ordinance

(Waive 1st and 2nd Readings)

Accept the recommendation of the Committee of the Whole, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3455) AMENDING THE VILLAGE OF FRANKFORT CODE OF ORDINANCES, CHAPTER 113: INTOXICATING LIQUOR, SECTION 113.02 TO ADD A DEFINITION FOR A BOWLING ALLEY AND SECTION 113.18 TO REVISE THE B-1 LIQUOR CLASSIFICATION (BOWLING ALLEY PERMITTING BAR, NO CARRY-OUTS).

2. 2024 Water Main Replacement Program: Bid Award- Resolution

Accept the recommendation of the Committee of the Whole and adopt A RESOLUTION (NO. 24-15) AUTHORIZING THE EXECUTION OF A CONTRACT BETWEEN THE VILLAGE OF FRANKFORT AND P.T. FERRO CONSTRUCTION CO., for the 2024 Water Main Replacement Program, in the amount of $1,193,383.00.

3. Pickup Truck Purchase Approval - Resolution

Accept the recommendation of the Committee of the Whole and adopt A RESOLUTION (NO. 24-16) AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE VILLAGE OF FRANKFORT AND PHILLIPS CHEVROLET OF FRANKFORT, for the purchase of a 2025 Chevrolet Silverado 3500HD, 4WD, regular cab work truck, in the amount of $49,623.03.

4. Dump Truck Purchase Approval - Resolution

Accept the recommendation of the Committee of the Whole and adopt A RESOLUTION (NO. 24-17) AUTHORIZING THE EXECUTION OF A CONTRACT BETWEEN THE VILLAGE OF FRANKFORT AND RUSH TRUCK CENTERS, for the purchase of a 2024 International HV507 truck equipped with a dump body and snow removal equipment, in the amount of $244,079.07.

5. Self-Contained Leaf Truck Purchase Approval - Resolution

Accept the recommendation of the Committee of the Whole and adopt A RESOLUTION (NO. 24-18) AUTHORIZING THE EXECUTION OF A CONTRACT BETWEEN THE VILLAGE OF FRANKFORT AND STANDARD EQUIPMENT, for the purchase of a 2024 ODB XtremeVac DCLl000SE Freightliner M2 Chassis, in the amount of $349,860.00.

Trustee Savaria moved, seconded by Trustee Petrow, to approve the Unanimous Consent Agenda.

Following a motion to approve, Trustees Borrelli, Leddin, Petrow, Rigoni, Rossi, and Savaria presented a brief overview of the consent agenda docket items under consideration for approval.

Clerk Schubert called the roll. Ayes: Trustees Borrelli, Leddin, Petrow, Rigoni, Rossi and Savaria. Nays: None. The motion carried.

PLAN COMMISSION REPORT SUMMARY

A. Planet Fitness: 20825 S. LaGrange Road

1. Special Use Permit for Indoor Recreation - Ordinance

2. Special Use Permit for Extended Hours of Operations - Ordinance

(Waive 1st and 2nd Readings)

Trustee Leddin reported applicant Black Duck Partners proposes to operate Planet Fitness, a gym/fitness facility within the southern portion of the tenant space currently occupied by Bargain

Mania in the Frankfort Town Center. Planet Fitness is proposing a 20,450 square foot tenant space, which is approximately half of the existing Bargain Mania's space. The Planet Fitness facility will feature weight training, a wellness pod (multi-sensory chair for relaxation), tanning beds, a Beauty Angel machine (red light therapy), and automated massage chairs. To accommodate the proposed business operation in the B-2 Community Business District, the applicant requests the granting of Special Use Permits for indoor recreation and extended hours of operation (24 hours a day, 7 days a week).

At the May 9, 2024 public hearing on the project, the Plan Commission forwarded a unanimous recommendation (6-0) for the Special Use Permit for indoor recreation and a split (4-2) recommendation to approve the Special Use Permit for extended hours of operation (24-hours).

At its June 12, 2024 meeting, the Committee of the Whole discussed the project and voiced their preference to see a modified schedule of 24/5 rather than 24/7 for the club hours. The applicant has amended their application for the Special Use Permit for extended hours of operation as follows:

• Monday: 24 hours

• Tuesday: 24 hours

• Wednesday: 24 hours

• Thursday: 24 hours

• Friday: 12:00 AM - 10:00 PM

• Saturday: 7:00 AM - 7:00 PM

• Sunday: 7:00 AM- 12:00 AM

Trustee Leddin moved, seconded by Trustee Savaria, to accept the Plan Commission recommendation, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3456) GRANTING A SPECIAL USE PERMIT FOR INDOOR RECREATION TO CERTAIN PROPERTY LOCATED WITHIN THE LIMITS OF THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINOIS (PLANET FITNESS: 20825 S. LAGRANGE ROAD) to pennit the operation of Planet Fitness, a gym/fitness facility, in accordance with the reviewed plans, public testimony, and Findings of Fact, and conditioned upon final approval from the Building Department and that the rear egress door shall remain closed at all times to avoid emission of sound beyond the tenant space.

Mayor Ogle invited trustee and audience comment on the Special Use Permit for indoor recreation prior to a vote.

Trustee Petrow commented on the parking requirements and the potential impact on the Frankfort Town Center (Butera) shopping plaza.

Mayor Ogle commented on the staff report which reflected it is generally accepted that there is sufficient parking in this shopping plaza.

Clerk Schubert called the roll. Ayes: Trustees Borrelli, Leddin, Rigoni, Rossi and Savaria. Nays: Trustee Petrow. The motion carried.

Trustee Leddin moved, seconded by Trustee Rossi, to accept the Plan Commission recommendation, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3457) GRANTING A SPECIAL USE PERMIT FOR EXTENDED HOURS OF OPERATION (MONDAY-THURSDAY: 24 HOURS; FRIDAY: 12:00 AM TO 10:00 PM; SATURDAY: 7:00 AM TO 7:00 PM; SUNDAY: 7:00 AM TO 12:00 AM) TO CERTAIN PROPERTY LOCATED WITHIN THE LIMITS OF THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINOIS (PLANET FITNESS: 20825 S. LAGRANGE ROAD), to permit the operation of Planet Fitness, a gym/fitness facility, in accordance with the reviewed plans, public testimony, and Findings of Fact, and conditioned upon final approval from the Building Department and that the rear egress door shall remain closed at all times to avoid emission of sound beyond the tenant space.

Mayor Ogle invited trustee and audience comment on the Special Use Permit for extended hours of operation prior to a vote.

Trustee Borrelli voiced his appreciation for the applicant's willingness to reconsider the 24/7 schedule, noting he would have preferred to see the reduced hours during the week as well.

Trustee Leddin asked about the process for rescinding the ordinance if there are any issues with the extended hours of operation. Administrator Piscia responded that the Village has a process to revoke a Special Use Permit.

Clerk Schubert called the roll. Ayes: Trustees Borrelli, Leddin, Rigoni, Rossi and Savaria. Nays: Trustee Petrow. The motion carried.

MAYOR'S REPORT

• Mayor Ogle reported the Village recently launched Nixle/Everbridge Emergency Notification System. He encouraged the public to sign up for the program by visiting the Village or Police Department Facebook page or the Village website at www.frankfortil.org under "What's Happening?".

• Mayor Ogle announced the weekly event calendar for downtown Frankfort: Cruisin' Frankfort (Mondays, 5:00 PM to 8:00 PM); Fridays on the Green featuring "Incredible Bats" (Friday, June 21, 10:00 AM to 11 :00 AM); Frankfort Country Market (Sundays, 9:00 AM to 1:00 PM); and Concerts on the Green featuring "No Tum on Red" (Sunday, June 23, 6:30 PM to 8:00 PM).

• Mayor Ogle reported the Frankfort Park District will host its 24th annual "Short Run on a Long Day" 5K Run/Walk on Wednesday, June 19, at 7:00 P.M. at Main Park.

• Mayor Ogle announced the annual "Get Hooked on Frankfort" fishing derby will be held on Saturday, June 22, at Prairie Park for youngsters 3 to 12.

• Mayor Ogle announced the next "Cone with a Cop" event is scheduled for Tuesday, June 25, from 1 :30 P.M. to 3:00 P.M. at Culver's, 20592 S. LaGrange Road. The Will County Sheriffs Department will provide a K9 demonstration at 2:00 P.M.

• Mayor Ogle reported on Sunday, June 16, a person called in a false report that there was an active shooter at the Frankfort Home Depot and the misinformation spread very quickly on social media. He highly encouraged the public to go directly to the Frankfort Police Department Facebook page to obtain accurate information before sharing on social media.

BOARD COMMENTS

Clerk Schubert reported the next Village Board meeting is Monday, July 1, 2024, at 7:00 P.M. and the next Committee of the Whole meeting will be Wednesday, July 10, at 5:30 P.M. at the Village Hall.

Members commented on the Frankfort Park District's annual "Short Run on a Long Day" 5K Run/Walk on Wednesday, June 19.

Members commented on the Nixle/Everbridge Emergency Notification System, which provides real-time alerts to keep the community informed during weather events, emergencies, and other critical situations.

The public was encouraged to follow the Village on social media to stay updated on the new downtown parking lots at 2 Smith Street and 11 White Street, the progress of the Pfeiffer Road extension project, construction of the new Prairie Park playground facility, and other community news.

The public was encouraged to contact the Chamber of Commerce for volunteer opportunities for this year's Fall Fest.

Members wished everyone a happy Father's Day.

OTHER BUSINESS

There were no other items of business.

PUBLIC COMMENT

No public comments were addressed to the Village Board.

ADJOURNMENT

Hearing no further business, Mayor Ogle called for a motion to adjourn. Trustee Borrelli moved, seconded by Trustee Rigoni, to adjourn the regular board meeting of Monday, June 17, 2024. The motion was approved by unanimous voice vote. The meeting adjourned at 7:26 P.M.
