LIAISON REPORTS:

1. Mayor Streit provided update on the Maker’s Park on the old Chevron property. The property is 10 acres. The proposed concept is to have viable “maker” businesses. Joliet is interested in participating by creating kitchens and restaurants. The feasibility project is fully funded; the original kick-off meeting has taken place. In the immediate future, SpaceLab will be taking residence on the first floor.

Request to rearrange the order of the agenda items, to place AT-1 as the last item of business.

AT-2. Amendment to Chapter 110 of the City Code to Increase the Total Number of C-1 and C-2 Liquor Licenses

City Attorney, Sonni Williams, presented the update on the City’s liquor licenses. The C-1 licenses are for restaurants with full bar, C-2 licenses are for restaurants with entertainment. 19 restaurant liquor licenses have been issues in Lockport, and are at the maximum. Additional requests for liquor licenses have been received for Mod Pizza (C-1) and Papa Joe’s at the 944 E 9th Street Lockport Plaza (C-2) and Chipotle (C-1). Requesting to increase the maximum number of licenses to be a total of 50 licenses.

DIRECTION: Add to the Consent Agenda on the 9/4 City Council Meeting.

AT-3. License Agreement for the Use of the City's Right-of-Way by the Owners of the Property at 1504 Hamilton Street

City Attorney, Sonni Williams, presented the report on the plat of survey related to 1504 Hamilton. Sections of the property encroach into the City’s right-of-way. The request is to establish a license agreement with the property owners to maintain the encroachment, and not add to the encroachment. The license will be at the cost of $1 per year. The property owners have no objections to the plan and the license agreement.

DIRECTION: Add to the Consent Agenda on the 9/4 City Council Meeting.

PD-1. Request to Purchase Two Downtown Security Camera Systems

Chief of Police, Terry Lemming, presented the request to purchase. There are 4 cameras within each of the two systems. The Asset Forfeiture fund will pay for the entire system. The total cost, based on the lowest bid is $26,635. The cameras are state-of-the-art and will record real- time. A future request may be made to tap-in to the IDOT electricity. Discussion about installation on the IDOT poles, and the possibility of tabling this item.

DIRECTION: This item will be tabled and brought back as an Action Item at a future meeting.

PW-1. Highland Ridge Development Offsite Utilities and Regional Lift Station Additional Cost

Director of Public Works, Brent Cann, presented the report on the Highland Ridge development. Additional sanitary sewer lines and utilities were identified as needed. The original property was budgeted at $1.1M paid for by the Developer fees for the property; the additional work of just over $190K. Requesting a change order for additional piping, rock removal, spoil removal, additional top soil and silt fence. The development agreement did state that any excess to the original project cost would be paid by the City, to be paid by surplus funds.

AT-1. Proposed Draft Amendment to Chapter 110 of the City Code Creating Video Gaming Terminal Licensing and Regulations

City Attorney, Sonni Williams, presented a summary of the current state of video gaming in the City of Lockport, based on the Council’s discussion in the August 7 COTW meeting. Staff conducted an analysis of video gaming in nearby municipalities including Homer Glen, New Lenox, Romeoville, Joliet, and Orland Park.

Brief summary of the classes of liquor licenses within Lockport:

A1 – bars and packages liquor B1 – bars (no packaged liquors) B2 – bars with entertainment C1 – restaurant

C2 – restaurant with entertainment

D1 – Social/Fraternal Club liquor license

D2 – Social/Fraternal Club liquor license, with entertainment E – packaged goods only liquor sales

F – special events (charitable)

G1 – wine only liquor license

G2 – wine and entertainment liquor license

G3 – health spa liquor license

H – tasting/sampling

H1 – supermarket sales

H2 – supermarket sales

J1 – Restaurant – beer/wine

J2 – Restaurant – beer/wine with entertainment

K1 – Rental hall liquor license

K2 – hotel and entertainment liquor license

L1 – brew pub

L2 – craft brewery

L3 – craft distillery

M – events on publicly owned property

Presentation of a proposed amendment to Chapter 110, including details of the licensure, ordinance and enforcement details. The proposed changes are focused on the C1 and C2 licenses, to introduce local control to govern video gaming within the City. As a home rule community, this is an opportunity to review and make improvements to the ordinance. The Council can decide how to implement the changes, whether to limit the number of machines, phase-out specific liquor licenses as current license-holders close or leave the City.

Discussion among the Council ensued. Discussion of an appropriate waiting period, or creating fees for the operator or distributor for each machine. Discussion of the possibility of establishing an independent video gaming commission. Discussion of separating the liquor license from the video gaming licensing. Discussion about the classes of licenses and clarifying the definitions of the licenses.

DIRECTION: For information only. Additional edits needed to the proposed amendment, to be presented at a future City Council meeting, in preparation to implement the changes on January 1, 2020. Changes include 6 month wait, $2500 fee to distributors, $1000 annual fee to business owner, establish video gaming commission with 3 independent non-council members, 60% minimum revenue requirement on base business activity, requirements for gaming area screening, 24 month requirement for existing restaurant businesses to be compliant with the changes.
