Manhattan planning commission modifies special use permits

The village of Manhattan Planning & Zoning Commission met March 22 to modify special use permits.

Here are the meeting's minutes, as provided by the commission:

VILLAGE OF MANHATTAN PLANNING AND ZONING COMMISSION MEETING MINUTES March 22, 2016 6:00 P.M.

CALL TO ORDER: A meeting of the Village of Manhattan Planning and Zoning Commission was held on Tuesday, March 22, 2016. Committee Chairman Doyle called the meeting to order at 6:00 p.m.

ROLL CALL: Present were Committee Chairman Andrew Doyle - aye, Raynae Williams - aye, Steven Krol - aye, Michael O'Neill - aye, Bill Bukovsky - aye, and Kyle Robbins – aye. Also present were Community Development Director Marc Nelson and Building and Zoning Clerk, June Bain.

APPROVAL OF MINUTES: A motion was made by Bukovsky to approve the Minutes of the February 23, 2015 meeting and seconded by O’Neill. Roll call: Williams - abstain, Krol - aye, O'Neill - aye, Bukovsky - aye, Robbins – aye, Doyle - aye (5 ayes, 0 nays, 1 abstain). Motion carried.

PUBLIC HEARING FOR AN AMENDMENT TO THE VILLAGE ZONING ORDINANCE WITH RESPECT TO THE MODIFICATION OF PERMITTED AND SPECIAL USES

A motion was made to open the Public Hearing for an Amendment to the Village Zoning Ordinance with respect to the modification of Permitted and Special Uses by O’Neill and seconded by Krol. Roll call: Krol - aye, O’Neill - aye, Bukovsky - aye, Robbins – aye, Doyle - aye, Williams – aye (6 ayes, 0 nay). Motion carried.

Community Development Director Marc Nelson confirms Notice of the Public Hearing was placed in the newspaper.

Community Development Director Nelson presents the staff report. Nelson explains that since the adoption of the Village Zoning Ordinance in the early 1970s some uses and stores did not exist, such as wireless communications. Also, other uses need to be properly identified because they were not addressed in the original Ordinance, such as tattoo establishments and currency exchanges, and need to be properly identified where these businesses should be allowed. In addition, revision of some of the existing uses in the Ordinance is needed.

Nelson advises that there are two charts presented. One chart is to identify existing uses and the other is to identify uses that are proposed to be added to the Zoning Ordinance. Nelson also explains that some uses conflict with each other. As an example, on the existing uses chart package liquor stores are listed twice in the Ordinance and was labeled as both a permitted and special use in the C-1 and C-2 Zoning District.

The proposed new uses chart lists uses that are not currently identified in the Zoning Ordinance and therefore need to be placed in a category. Nelson also advises that it is important to place uses in the appropriate zoning category because the Village cannot prohibit a use from the Village in the Zoning Ordinance. Attached also with the charts is a description of each Zoning District from the Zoning Ordinance.

Commissioners ask clarification on descriptions of various uses.

With no further questions, a motion was made to close the Public Hearing for an Amendment to the Village Zoning Ordinance with respect to the modification of Permitted and Special Uses by Bukovsky and seconded by O’Neill. Roll call: O’Neill – aye, Bukovsky - aye, Robbins – aye, Doyle – aye, Williams - aye, Krol – aye, (6 ayes, 0 nays). Motion carried.

A motion was made to approve an Amendment to the Village Zoning Ordinance with respect to the modification of Permitted and Special Uses by Bukovsky and seconded by Robbins. Roll Call: Bukovsky - aye, Robbins - aye, Doyle – aye, Williams – aye, Krol - aye, O’Neill – aye (6 ayes, 0 nays). Motion carried subject to the following modifications:

• Alcohol Brewery Tasting Establishments added as a Special Use in C3, CBD and the BP Districts

• Add Massage or Day Spa Establishments as a Special Use in the C3 District

• Title Loans separated from Currency Exchange as a separate use

• Allow Currency Exchanges as a Special Use Permit in the C3 District

OLD BUSINESS: There was no old business.

NEW BUSINESS: Board Member, James Jackson, has resigned because he no longer lives in Manhattan.

ADJOURNMENT: A motion was made to adjourn at 7:02 p.m. by O’Neill and seconded by Krol. Roll call: Robbins – aye, Doyle - aye, Williams – aye, Krol - aye, O’Neill – aye, Bukovsky – aye, (6 ayes, 0 nays). Motion carried.

Next meeting scheduled is April 26, 2016.
