Village of Homer Glen Village Board met Aug. 13.

Here are the minutes provided by the board:

A. CALL TO ORDER 

The meeting was called to order on August 13, 2025 by Mayor Neitzke-Troike at 6:30 p.m. in the Village Board Room, 14240 W. 151st Street, Homer Glen.

B. PLEDGE OF ALLEGIANCE TO THE FLAG

C. MOMENT OF SILENCE – Dedicated to Army Specialist E4 Eric Keith Lee and Gabriella Rose Kucich Matlak.

D. ROLL CALL

Present were Mayor Christina Neitzke-Troike, Trustees Curtis Mason, Rose Reynders, Mike Lepore, Nick Muller, Bart Holzhauser and Robert Schaller. Also present on behalf of the Village were, Attorney Michael Pasquinelli, Village Engineer Brett Westcott, Finance Director & HR Director Lisa Kopas, Planning & Zoning Director Christopher Gruba, Economic Development Director Janie Patch, Village Clerk Candice Bielski and Village Manager Joe Baber. A quorum was established.

E. COMMUNITY REGOGNITION –

1. Recognizing Austin Bielski - Raising awareness and money for children and teens fighting cancer through his "Cups 4 Cancer" Lemonade Stand. Trustee Reynders read a brief history on Cups4Cancer.

Austin Bielski started his Cups4Cancer Lemonade Stand in 2018, when he was 8 years old. His first year he raised $110.00 and was so excited to bring all the crumpled-up money to The Pediatric Oncology Treasure Chest Foundation, that when he left, he asked to have the lemonade stand again....but this time he wanted to offer more than just lemonade. In 2019, Austin offered bottled water and a sugar free lemonade in addition to regular lemonade and he raised and donated $643.55 once again to TPOTCF. Then in 2020, Covid hit and things were up in the air. Austin asked about doing the lemonade stand again and his parents were just unsure if it could happen. But after much thought, they decided that Cancer doesn't stop because of Covid so Cups4Cancer wasn't stopping. Austin sat out there with his brothers for 2 days and with a little extra help from his mom's social media posts - he raised and donated $1,981.58 to TPOTCF. In 2021, Austin's mom was contacted by a local realtor in Lemont, Christine Wilczek. She wanted to hear how Austin came up with the idea of Cups4Cancer and she wanted to sponsor his next lemonade stand. Austin worked with their graphic designer to create a logo for the keepsake cups and t-shirts. Christine and Realty Executives Elite got the donation ball rolling with a post on Facebook and Instagram.

The post read: Meet our friend, Austin Bielski. Austin is an 11-year-old from Homer Glen with a heart of pure gold. Austin hosts an annual Cups 4 Cancer lemonade stand and donates 100% of his profits to The Pediatric Oncology Treasure Chest Foundation. During the last 4 years, Austin has raised over $3,000.00 for this wonderful organization. We are proud to announce that we are sponsoring Austin and his CUPS 4 CANCER event this year. Our graphic artist is working with Austin on logo design, custom cups, t-shirts and marketing.

We will surprise Austin and donate $1.00 for every LIKE this post gets in the next 24 hours.

So in 2021, Austin raised and donated $7,675 to TPOTCF. The following year (2022) total was $6,765.

In 2023, the Cups 4 Cancer Lemonade stand hit the road, so to speak, and set up in May at the Lockport Township High School - Porter Baseball Strike Out Cancer Event. Cups4Cancer raised and donated $1100 to the CC2 Forever Foundation in honor of Connor Christian, a former LTHS graduate and baseball player. Then in July, Cups 4 Cancer raised and donated $8000.52 to TPOTCF. The final donation of $500.00 for 2023 was raised during September, when the Homer Stallions hosted their GOLD OUT game and this went to Cal's Angels.

2024 - once again set up at the LTHS Strike Out Cancer, raised and donated $200 to CC2 Forever Foundation. In July of 2024, Austin had set a big goal of wanting to surpass the amount raised from the previous year and he also talked about retiring the Cups 4 Cancer Lemonade stand, because he felt he was kind of getting too old for it. He was just a few bucks off from his goal that year. The amount raised and donated to TPOTCF in 2024 was $7,951. If you add all that up it comes to $34, 917.65!!!

Clearly things did not end there because we wouldn't be here today. This past February, Austin found out that a former classmate and team mate from Homer Junior High, Dylan Krestan, had been diagnosed with Hodgkins Lymphoma. Austin and his family had a few chats and decided that they wanted to show support for Dylan. Cups 4 Cancer was not going to be retiring after all!!! A few conversations happened with Christine Wilczek, Gina Krestan (Dylan's mom) and Maggie from Weish4Ever. This story could go on forever, but with the support from this community, surrounding communities, local businesses, 72 Acts of Kindness and so many special, special people - the 2025 Cups4Cancer Lemonade Stand raised and is donating $15,000 to WEISH4EVER, making Austin just $83 short of his $50,000 Ultimate Goal.

Trustee Reynders donated $90 to Cups for Cancer helping Austing hit that $50,000 goal.

2. Plastic Free July - Taylor Udarbe - The Village of Homer Glen hosted a plastic free July competition to raise awareness regarding the plastic waste problem. Residents were asked to submit their tips and tricks to reduce plastic waste. Taylor presented the winners with a certificate and a gift card. First place winner was Isadora, winning a $200 gift certificate to Tazza. Second place winner was Amy, $150 gift certificate to The Phoenix. Third place winner was Lynn, $100 to Blueberry Hill.

F. AMENDMENTS TO THE AGENDA –

1. Trustee Mason motioned to amend L.6 wording, "Is there a motion to approve an Ordinance implementing both a municipal grocery retailers' occupation tax and a municipal grocery service occupation tax in accordance with section 8-11-24 of the Illinois Municipal Code.”

I. PUBLIC COMMENT -

1. Joy Piwowar - Bengtson's employee since 2005. She talks about how it is a tight knit group of people and her positive work experience.

2. Jennifer Consolino - Wanted to address there is an open ground utility box at the corner of 151st & Rosarie. Stated she emailed the Village manager a month ago but never received a response. She asked the Village staff to address this immediately. Ms. Consolino stated that as a former trustee she does not support L.6. She wanted to address an email she submitted to staff and trustees on Monday. Ms. Consolino mentioned she was appalled that information regarding L.7 through L.10 was left out of the packet. She said this demonstrates a lack of ethics and transparency. Ms. Consolino said "who the hell do you people know that wants this kind of debauchery in the proximity to their children and homes? This is not the kind of activity families want permitted in Homer Glen, this is not Chicago Heights lined with strip clubs even though Paul O'Grady would like it to be....."

3. Scott Bengtson - he and his father are the owners of Bengtson Farm. Stated they have been part of Homer for six generations and the farm has been around since 1981. This will be the 45th season in business. Mr. Bengtson stated that last year they decided to do a summer fest and came in and met with Joe Baber and Village President Christina to go over the details. Mr. Bengtson stated both agreed that all this fell within their PUD. Stated they opened last summer without hearing any issues from the Village. Mr. Bengtson read from a piece of paper that he said was an email with a FOIA request sent from Joe Baber to the Mayor, Clerk and Village Trustees. He said this year they were called into a meeting and were told that summer fest might not be allowed and may only be granted year by year if they fill out a special event permit, which was not the requirement last year as summer is covered under the current PUD. Mr. Bengtson stated that when asked why the reversal, they weren't really given any real answers other than some neighbor complaints. Mr. Bengtson stated the Village is using this to "push their new agenda." Mr. Bengtson stated Casey came out and gave them violation notices and this is being done intentionally to harm their business. Mr. Bengtson stated the permits are for a ride foundation that is similar to one that was approved last year and for a pavilion that is duplicate to another one granted earlier this very year. Mr. Bengtson stated he sent in a FOIA and received very concerning emails from Village officials and Village President, Christina herself.

Trustee Lepore motioned to grant three additional minutes, Trustee Mason second.

Mr. Bengtson continued – he said that "she" informed the neighbors that we installed the swing ride without consent even though “we” have had extensive discussions and a meeting about this ride. Mr. Bengtson said "which is interesting, because rides have always been a part of this business since 1999, since before the Village was even established." He states that "they" have always been aware of the rides and in the loop on them. Mr. Bengtson said “I have to point out that the Village President, Christina, has long standing ties to the only competing business in town and after looking into it, there seems to be many issues in their PUD versus the way they actually operate."

4. Lindsey Hecker – Full time employee at Bengtson's. She explained what she does at Bengtson's. Ms. Hecker said the village is working behind the scenes to see Bengtson's fail.

5. Susan Ally - resident of Homer Glen since 1990. Asked why the Village is treating any business the way Bengtson's is being treated.

6. Kate Quinn - Lemont resident. Part time Bengtson's employee. Enjoys working at Bengtson's and said look at how many people showed up for one little pumpkin farm. Stated she received an email today about what was going on and found it absolutely horrible. "Why would you want to do this to a business?" She went on to say that she recently began working in special education in a Homer school and "what are we supposed to say when the Bengtson pumpkin farm is no more?”

7. John Zutant - Homer Glen resident since 1993. Wanted to express the same sentiment as many who work at Bengtson's. Said it is a family-owned business, they pay taxes here in Homer Glen just like anybody else. Mr. Zutant said you have to improve to grow.

8. Christy Nahser - from Chrislin Farm. Glad to see so much support for Bengtson's. She said Homer Glen is unique for open space and Bengtson's is so incredibly unique. People come from all over to go to Bengtson's. She also asked to tone down the fireworks because of the animals in the area.

9. John Walters - resident of Homer Glen since 2002. In regards to L.6, he stated that raising taxes is the easiest, laziest thing to do. He would like to see discussions and no more new taxes. In regards to L.7, he asked what are you trying to change? Are you trying to allow adult entertainment to be here in Homer Glen?

J. REPORTS AND COMMUNICATIONS FROM MAYOR AND OTHER OFFICERS

Village Manager Baber - wanted to commend the Parks, Events and EMA departments in their efforts for the Fire & Ice event that took place in Heritage Park. The Illinois Landscape Professionals Association thanked the Village of Homer Glen and presented the Village with an appreciation plaque.

A number of businesses will experience electrical outages next week in the vicinity of 143rd Street & Bell Road. The businesses have been notified and the outages will occur between the hours of 1AM and 6AM, due to on-going construction in the area.

In the process of updating the off-road vehicle ordinance to include e-bikes, e-scooters and alike. Use of these devices has become out of control in the community and created numerous dangerous situations.

Trustees:

Trustee Holzhauser - thanked residents, fellow board members and the mayor for allowing him the opportunity to serve Homer Glen on this board and he congratulated Austin Bielski on his fundraising efforts with Cups4Cancer.

Trustee Lepore - welcomed Trustee Holzhauser. Reported for the Economic Development Committee. Working on a promotional flyer featuring local businesses. Would like to work with and partner with the local pumpkin farms to pass out flyers to the patrons that visit these establishments to give local dining and business options to the many that come from all over the state of Illinois and further to visit our town.

Trustee Mason - Welcomed Trustee Holzhauser. Congrats to Austin Bielski. Reported for the Public Safety Committee. Stated they had their safety meeting on August 6, 2025 and during the meeting they discussed several topics. They talked about enhanced security with cameras. Trustee Mason stated that cameras are becoming increasingly vital for public service and safety agencies to secure, detour crime and improve operational efficiency. He gave some examples of how cameras are being used in surrounding towns. Another topic Trustee Mason addressed is ATVs, side by sides and dirt bikes.

Stated that over the weekend he was notified multiple times about person(s) utilizing the new portion of Heroes Trail as their own personal dirt track. Talked about suggestions for holding the parents accountable for their child(ren)'s actions.

Trustee Mason commended Ron Kus for his efforts in helping locate a missing person on July 2, 2025 in the Village of Elwood.

Trustee Reynders – reported for the Parks Committee. Thanked everyone who came out today to the ribbon cutting for the Old Oak Park. August 18, 2025 the Park Committee will kick off the 1st phase of changes coming to Heritage Park. It is an open meeting to discuss the changes coming to add a Veterans Memorial and a water feature.

Trustee Reynders addressed some concerns that were brought to her attention about items on the consent agenda that are being complained about. She stated that items on a consent agenda are reviewed ahead of time in Admin & Finance Committee. Trustee Reynders stated that she recalls several trustees last year that wanted to bring Admin & Finance back as a committee because we were spending so many hours on this board discussing matters. She explained what happens in A&F meetings.

Trustee Muller - welcomed Trustee Holzhauser. Mentioned that school is a week away and people need to pay more attention to kids headed out to the bus. Trustee Muller also stated that in regards to what Trustee Mason spoke about with the flock cameras, it's not big brother watching every move you make. He said there is certain criteria that has to be input to even look at these cameras. He would be more than happy to discuss any questions anyone has.

Trustee Schaller - Kudos to Ron Kus and Casey for dealing with a long ongoing code enforcement issue. Thanked the Sabo's for the invitation to their residence to see what the Conservation Foundation is about.

Village Clerk - no report

Village Attorney -- gave an update on Illinois American Water. Mr. Pasquinelli stated that Village of Homer Glen has been invited by the Illinois Attorney General to participate in a conference call with IAW on August 28, 2025.

Mr. Pasquinelli wanted to address one of the agenda items. He stated he was away on family vacation for over a week. There were a couple of ordinances that did not make it to the actual packet. Mr. Pasquinelli stated that per the Open Meetings Act, the agenda is what is required to list, with reasonable particularities, the topics that the board is going to discuss. He stated that all the agenda items were properly noted and listed on the agenda. Mr. Pasquinelli stated to allay any concerns about actual, physical nudity being allowed, that is not accurate, the ordinance does not allow that.

Public Safety Officials – Lieutenant Piazza reported that he spoke with Sargent Obermier of Will County Investigations and he agreed to come out two weeks from today to answer any questions for Flock indepth.

Mayor Neitzke-Troike - addressed "the elephant in the room.” The Mayor stated she is unsure what "email" the public received, but it was mentioned twice tonight in the comments that Bengtson's was being shut down. Mayor Neitzke-Troike stated that Bengtson's is not being shut down, "their pumpkin farm is not being shut down." She addressed the accusations about her working at a competitor. The Mayor stated, "if you remember correctly, when this Village in 2015, had an argument (not this board obviously), but the mayor at that time was trying to take over the property where Bengtson's was renting. And if you remember correctly, I stuck up for you guys and lead the charge to help you guys get that property and stay as Bengtson's." She stated yes, "I do work at Konow's but we never visualized as a competitor," they are two completely different places. Mayor Neitzke-Troike stated there is protocol, in the PUD (planned use development) it says what you are allowed to do and what you are not allowed to do. In order to make that happen, a Special Event Permit is required. That is all the board was asking, even the attorneys all agreed that was what was needed but it was refused.

Gave an update regarding 143rd Street -- there is a meeting with the County Executive and her staff to discuss the expansion.

K. CONSENT AGENDA

1. Consider for Approval the Accounts Payable for the Period of July 26, 2025 through August 14, 2025 in the amount of $338,536.60.

2. Consider for Approval the quote(s) from Bengtson's and Spring Grove Nursery for the installation and purchase of parkway trees for the 2025 Fall tree planting program in the amount of $33,450.00.

3. Consider for Approval a Payment for the Village of Homer Glen's June Legal Bills from Peterson, Johnson and Murray in the Amount of $13,673.50.

4. Consider for Approval the Payment of an invoice for phase one of the Curb and Sidewalk Replacement program in the amount of $173,476.25.

5. Consider for Approval the Purchase of a John Deere 5090E Mowing Tractor for Public Works in the amount of $49,864.61.

1. Consider for Approval a reimbursement grant award under the Commercial Building Improvement Grant Program to Lunar Management (owner of Galaxy Plaza) for eligible improvements at 14310 S Will-Cook Road in the amount of $5,326.80.

Discussion - Trustee Lepore - this is a grant program that is run through the Economic Development Committee.

Trustee Reynders - has worked with Janie Patch in the past on this grant program and several businesses in the Village have taken advantage of it.

Trustee Schaller - asked if this can be pushed out through social media.

2. Consider for Approval of a landscape plan for a 2,277 square foot, detached accessory structure to satisfy the condition of approval for 13506 W. 167th Street, case HG-2506-V]. Trustee Mason motioned to approve, Trustee Schaller second.

Consider for Approval an Ordinance granting [1] Variance to permit an inground pool and pool patio as an obstruction in a front yard; [2] a Variance to reduce the required front yard setback for the in-ground pool and patio from a non-dedicated right-of-way from eighty (80) feet to fifty three (53) feet, and; [3] a Variance to reduce the required side yard setback for the in-ground pool from twenty (20) feet to fourteen (14) feet for certain real property located in the R-2 Single-Family Residential Zoning District at 12258 W. Rambling Rd, Homer Glen, Illinois [HG-2521-V].

4. Consider for Approval an Ordinance granting [1] Variance to permit a multitenant sign with seven (7) tenant panels where no more than six (6) are permitted and [2] a Variance to permit a ground sign as an obstruction in the required clear vision triangular area for certain real property located in the C-1 Neighborhood Commercial Zoning District at the common address 14322 S. Golden Oak Dr, Homer Glen, Illinois [HG-2520-V] with the following condition.

The applicant shall stripe two(2) handicap parking stall per ADA requirements that are 11 feet wide with a five(5) foot loading space.

Trustee Lepore motioned to approve, Trustee Reynders second.

Discussion - Trustee Lepore stated he does have a business interest in one of these locations so he will be abstaining his vote.

5. Consider for Approval an Ordinance granting a special use permit for a large group home for certain real property located in the A-1 Agricultural zoning district at 17535 S. Parker, Homer Glen, Illinois [HG-2426-SP].

Trustee Reynders motioned to approve, Trustee Schaller second.

Discussion - Director Gruba gave an explanation of what the special permit request was for. Mr. Gruba stated there has been some code violations, some have since been fixed and some are outstanding. The planning commission did recommend unanimous denial. Trustee Reynders – asked Director Gruba if he knew how long they had been in the home health care business? Director Gruba said his understanding is yes they have been in the home health business but the records are "a bit mysterious, for a lack of a better word." He said he is unsure, but the applicant is here tonight. Trustee Reynders asked what experience they have in home health care? Mayor Neitzke-Troike asked if the petitioner wanted to step up to the podium and answer questions. The petitioner stated for 20 years in Lemont, she was in home care. Trustee Reynders asked if the home care she was running in Lemont was licensed by the state. The petitioner said yes. Trustee Reynders asked petitioner if she was a physician. Petitioner stated, "I am not physician, just from Lithuania physician."

Trustee Reynders and Mayor Neitzke-Troike asked Director Gruba some additional questions regarding the "license" the petitioner mentions.

Trustee Schaller - asked Director Gruba if there was a business license in the Village for this. Mr. Gruba states that there is a business license that is for a day care, issued in August 2024.

Trustee Mason - had comments and concerns regarding the list of violations.

Trustee Muller - stated there seems to be deficiencies with the information provided.

6. Consider for Approval an Ordinance implementing a municipal grocery retailers' occupation tax and a municipal grocery service occupation tax of 1% for the Village of Homer Glen in accordance with section 8-11-24 of the Illinois Municipal Code.

Trustee Reynders motioned to approve, Trustee Lepore second.

Discussion - Trustee Reynders - stated that she did some research, and back in 1990, this grocery tax was implemented. She said one of the reasons this tax was implemented was to prevent individual municipalities from incorporating the tax. Trustee Reynders stated now the governor is just trying to change the payment path.

Trustee Lepore - stated this not a new tax, it's just a new method of collecting. Neighboring towns are also doing the same.

Trustee Mason - stated this was discussed in A&F at great length.

Trustee Schaller - stated he did some research and digging on this. He agrees no extra taxes, but what is being lost is what is happening down in Springfield to our municipalities. Trustee Schaller states that we must adopt this one percent local grocery tax. "Especially given the ongoing reductions in the local government distributive fund - LGDF."

Finance Director John Sawyers - Gave a brief statement on sales tax. Mr. Sawyers stated that the one percent sales tax on groceries funds most of the village operations - police, public works, EMA, all operations except park facilities and park improvements. Sales tax is a pass through tax, which means many non-residents buy their goods here and pay the tax and it comes to the village. Mr. Sawyers states it is significantly important to the Village and to all Villages. He said it is not a new tax it's a replacement tax. Costs will not go up due to this change. This is the life line of Villages, and particularly this Village.

7. Consider for Approval an Ordinance Amending Chapter 83-74(G) of the Village Code to permit limited entertainment upon or within a premises licensed to sell alcohol subject to the Village review, approval and issuance of a Special Event Permit.

Discussion - Trustee Reynders stated that everyone is under the misconception that the Village is targeting Bengtson's for a special use permit. This is not the case. Trustee Reynders stated this is going to prevent any business in Homer Glen from doing whatever they want at any time. This is to make sure these events would be monitored.

Trustee Mason - stated that the Village needs to have the ability to monitor. This was not targeted towards Bengtson's.

Trustee Schaller - Special Use permits are the norm, especially for businesses looking to do anything outside of their PUD. Trustee Schaller feels it is good business for the Village to continue.

Trustee Lepore - Stated he is not a fan of government interfering with businesses at any level. Trustee Lepore said over regulation is a concern.

Mayor Neitzke-Troike - stated this motion is to make less restrictive just so everyone is clear.

The Mayor asked the Clerk to call the Roll:

8. Consider for Approval a motion to authorize the Village President/Village Manager to execute a Franchise Agreement with Delta Communications, LLC d/b/a Clearwave Fiber, subject to the review and approval of the Village Attorney.

Trustee Mason motioned to approve, Trustee Muller second.

Discussion - Attorney Pasquinelli “walked” the trustees briefly through the master agreement. He stated the first several pages are a template and the latter part has revisions made by the attorney that are his recommendation.

Trustee Mason thanked Lt. Pete Piazza for putting together a comprehensive plan to initiate and place the cameras.

1. Pulled from Legislative and Action items - Consider for Approval a motion to supplement and

amend § 1-19 and § 1-20 of the Village Code, to establish additional substantive and procedural rules to govern administrative proceedings in the Village of Homer Glen.

Discussion - Attorney Pasquinelli gave some explanation to item L.9. He also provided a hand out of City of Chicago Administrative Hearing Procedural Rules (see attached).
