City of Wilmington Planning & Zoning Commission met May 23.

Here are the minutes provided by the commission:

Call to Order

The May 23, 2024 meeting of the Wilmington Planning & Zoning Commission was called to order at 5:09 p.m. by Commissioner Chris Smith.

Appointment of Pro Tem Chairperson

Commissioner Clennon made the motion and Commissioner Longest seconded to elect Commissioner Smith as Pro-Tem Chairperson for the May 23, 2024, Planning and Zoning Commission meeting.

Upon roll call, the vote was:

AYES: 4 Clennon, Longest, Francis Smith

NAYS: 0

ABSENT: 3 Humphries, Studer, Tryner

Motion passed.

Roll Call

Upon Roll Call by the Clerk the following members answered “Here” or “Present”: Commissioners Present Smith, Clennon, Longest, Francis

Commissioner Absent Humphries, Studer, Tryner

Quorum

There being a sufficient number of members of the corporate authorities in attendance to constitute a quorum, the meeting was declared in order.

Also, in attendance were City Administrator Jeannine Smith, Mayor Ben Dietz, Attorney Bryan Wellner and Deputy City Clerk Joie Ziller

Approve the Previous Meeting Minutes

Commissioner Clennon made a motion and Commissioner Longest seconded to approve the March 7, 2024 meeting minutes and have them placed on file

Upon roll call, the vote was:

AYES: 4 Clennon, Longest, Francis, Smith

NAYS: 0

ABSENT: 3 Humphries, Studer, Tryner

Motion passed.

Public Hearing to Consider Request by Petitioner, Operating Engineers Local 150 Apprenticeship Fund, 19800 W Arsenal Road, in Regards to a Planned Unit Development Amendment for a 105,600 Square Foot Building Expansion Located at 19800 W Arsenal Road

Commissioner Longest made a motion and Commissioner Clennon seconded to open the public hearing at 5:10 PM

Upon roll call, the vote was:

AYES: 4 Longest, Clennon, Francis, Smith

NAYS: 0

ABSENT: 3 Humphries, Studer, Tryner

Motion passed.

Deputy Clerk Ziller verified that the public hearing notice was published on May 8, 2024, a sign was posted at the subject property on May 3, 2024, and notifications were sent via USPS Certified Mail to all adjacent property owners within 250 feet of said property on May 3, 2024.

City Administrator Smith summarized the staff report which was also included in the agenda packet.

Deputy City Clerk Ziller administered the oath to Carra Scurto.

Carra Scurto, representing Local 150 introduced herself to the Commission and explained the proposed project to construct a new building on their current property with the height of this building being 52 feet.

No additional public comments were made.

Commissioner Longest made a motion and Commissioner Clennon seconded to close the public hearing at 5:14 PM

Upon roll call, the vote was:

AYES: 4 Longest, Clennon, Francis, Smith

ABSENT: 3 Humphries, Studer, Tryner

Commissioner Clennon made a motion and Commissioner Longest seconded to approve the request by petitioner Operating Engineers Local 150 and recommend to the City Council to approve a PUD Special Use Permit for parcel number 09-18-16-400-004-0000 allowing for a 105,600 square foot expansion of the Petitioner’s training center and a conditional use pursuant to section 150.63 I-1 (c) (2) buildings whose height exceeds the maximum building height in the I-1 district for a maximum height of 52’ from the permitted height of 45’ as presented

Upon roll call, the vote was:

AYES: 4 Clennon, Longest, Francis, Smith

NAYS: 0

Public Hearing to Consider Request by Petitioner, David Rampa, 101 E Chicago Street, Unit 1, in Regards to a Variance Allowing for Storage Container Self-Service Mini Storage and Map Amendment to B3-General Commercial for Vacant Property and Property Located at 101 E Chicago Street

Administrator Smith informed the Commission that due to Scribner's error in the public notice that was published on May 8, 2024, this notice has been reissued to include the front yard setback variance from the required 40 feet to 20 feet and appear before you on June 6, 2024. However, I requested the petitioner to come forward tonight to discuss the matter.

Dave Rampa addressed the Commission with the proposed use for the vacant space. He mentioned that he had placed the containers there about a year ago and is planning to rent them for self-storage once in compliance with the City.

The Commission discussed the adaptive reuse of shipping containers as storage facilities, with concerns about code compliance and community acceptance, along with the potential impact of the downtown area for this specific request.

Public Hearing to Consider Request by Petitioner, City of Wilmington, Acting on Behalf of Begler’s, Inc., for Annexation, Conditional Use to Allow for Outdoor Storage and Map Amendment to B3-General Commercial of Approximately 0.36 Acres of Property Located at 211 North First Street and Map Amendment to B3-General Commercial of Approximately 0.16 Acres of Property Located on North First Street

Commissioner Longest made a motion and Commissioner Clennon seconded to open the public hearing at 5:34 PM

Upon roll call, the vote was:

AYES: 4 Longest, Clennon, Francis, Smith

NAYS: 0

ABSENT: 3 Humphries, Studer, Tryner

Motion passed.

Commissioner Longest made a motion and Commissioner Francis seconded to recommend to the City Council to approve the Begler’s Inc. annexation of PIN 03-17-26-405-038-0000, comply with the B3-Commercial zoning regulation with a conditional use that the current two cargo container at the property remain where they are and cannot be replaced once they are removed and that the owners combine ownership and consolidate the three separate PINs associated with the property and map amendment for PIN 03-17-26-405-037-0000 from R1-Residential Single Family to B3-Commercial as presented

AYES: 4 Clennon, Longest, Francis, Smith

NAYS: 0

ABSENT: 3 Humphries, Studer, Tryner

Motion passed.

Administrator Smith introduced Susie McDavid, the new Building Permit Tech.

Adjournment

A motion to adjourn the meeting was made by Commissioner Longest and seconded by Commissioner Francis. Upon voice vote, the motion was carried. The Wilmington Planning & Zoning meeting held on May 23, 2024, adjourned at 6:04 p.m.
