Village of Frankfort Village Board met Feb. 7.

Mayor Keith Ogle called the regular meeting of the Frankfort Village Board to order at 7:01 P.M.
ROLL CALL
Village Clerk Katie Schubert called the roll. In attendance were Mayor Keith Ogle, Clerk Katie Schubert, Trustees Adam Borrelli, Michael Leddin, Margaret Farina, Jessica Petrow, Daniel Rossi, and Gene Savaria. Also in attendance were Attorney George Mahoney, Attorney Hannah Lamore, Police Chief Leanne Chelepis, Village Administrator Rob Piscia, and Assistant Administrator John Burica.
HICKORY CREEK MIDDLE SCHOOL CHEER TEAM - PROCLAMATION
Trustee Farina made a motion (#1), seconded by Trustee Petrow, to approve a proclamation recognizing the Hickory Creek Middle School Cheer Team for their outstanding achievement in winning the 2022 Illinois Elementary School Association (IESA) Cheerleading State Championship. A voice vote was taken. All were in favor. The motion carried.
Mayor Ogle presented the Hickory Creek Middle School Cheer Team with a proclamation recognizing their achievement in winning the 2022 IESA Cheerleading State Championship and the cheer team performed a short demonstration of their competition routine.
APPROVAL OF SPECIAL ORDERS - UNANIMOUS CONSENT AGENDA
All items on the Omnibus Agenda are considered to be routine in nature and are enacted in one motion. There is no separate discussion of these items unless a board member makes a request, in which event, the item will be removed from the Consent Agenda and will be considered separately.
Trustee Petrow requested Item C (3) -Targeted Incentive Program be removed from the Consent Agenda.

a. Special Use Permit for Elementary School - Ordinance
(Waive 1st and 2nd Readings)
Accept the Plan Commission recommendation, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3341) GRANTING A SPECIAL USE PERMIT FOR AN INDOOR INSTITUTIONAL USE, SPECIFICALLY AN ELEMENTARY SCHOOL, FOR CERTAIN PROPERTY LOCATED WITHIN THE LIMITS OF THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINOIS (CHELSEA INTERMEDIATE SCHOOL - 22265 S. 80TH A VENUE), granting a Special Use Permit for an elementary school as part of the Chelsea Intermediate School addition and renovation project, in accordance with the reviewed plans and public testimony, conditioned on final engineering approval, screening the rooftop mechanical units from view, replacing any preservation trees lost as part of the site work, and the detention areas shall be planted with natural, native plantings.
b. Fence Design Variance- Ordinance

Accept the Plan Commission recommendation, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3342) GRANTING A FENCE DESIGN VARIANCE FOR CERTAIN PROPERTY LOCATED WITHIN THE LIMITS OF THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINOIS (CHELSEA INTERMEDIATE SCHOOL- 22265 S. 80TH A VENUE), granting a fence design variance from the decorative fence requirement to a cyclone type fence ( chain link fence) around the perimeter of the athletic track, in accordance with the reviewed plans and public testimony, and conditioned upon the fence being black, vinyl-coated.
c. Final Plat of Subdivision - Approval
Accept the Plan Commission recommendation and approve the Chelsea Intermediate School Final Plat of Subdivision, prepared by Marchese and Sons, Inc., revision dated 12.03.21, consolidating two existing parcels, in accordance with the reviewed plans and conditioned upon final engineering approval.
3. Special Use Permit for Massage Establishment: 20499 S. LaGrange Road - Ordinance (Waive 1st and 2nd Readings)
Accept the Plan Commission recommendation, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3343) GRANTING A SPECIAL USE PERMIT FOR A MASSAGE ESTABLISHMENT TO CERTAIN PROPERTY LOCATED WITHIN THE LIMITS OF THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINOIS (20499 S. LAGRANGE ROAD - THE VINEYARDS OF FRANKFORT RETAIL CENTER), to accommodate the operation of Massage CT, Inc., in accordance with the reviewed plans, public testimony, and Findings of Fact.
Trustee Savaria made a motion (#2), seconded by Trustee Borrelli, to approve the Unanimous Consent Agenda.
Trustees Farina, Leddin, Petrow, Rossi, and Savaria presented a brief overview of the consent agenda docket items under consideration for approval.
Mayor Ogle invited trustee comment on the consent agenda docket items prior to a vote being taken. None were forthcoming.
Clerk Schubert called the roll. Ayes: Trustees Borrelli, Farina, Leddin, Petrow, Rossi, and Savaria. Nays: None. The motion carried.
SALE OF SURPLUS REAL ESTATE: 2 SMITH STREET- ORDINANCE
Trustee Borrelli presented a brief overview of the Sale of Surplus Real Estate: 2 Smith Street agenda item. He reported the Village of Frankfort owns certain real estate improved with a single story building located at 2 Smith Street within the H-1 Historic District. At its January 18, 2022 meeting, the Committee of the Whole reviewed a draft ordinance regarding the potential sale of the Village-owned property and asked staff to work with legal counsel to finalize the ordinance for the sale of the property through the RFP process.
Trustee Borrelli made a motion (#3), seconded by Trustee Petrow, accept the recommendation of the Committee of the Whole, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3344) AUTHORIZING THE SALE OF SURPLUS PUBLIC REAL ESTATE FOR THE PROPERTY COMMONLY KNOWN AS 2 SMITH STREET, FRANKFORT, WILL COUNTY, ILLINOIS.
Mayor Ogle invited trustee comment on the agenda item prior to a vote being taken.
Trustee Farina voiced her appreciation for the opportunity to continue to develop property in the downtown district and the importance of doing so in a considerate matter. She voiced concerns of the parcel's close proximity and potential impact to the neighboring residential properties. She also voiced concerns regarding language in the ordinance and felt it did not accurately reflect the present use or proposed future use to utilize part of the property for a parking lot, noting the Village submitted a grant application with the State of Illinois for the demolition of the building and site improvements for the property.
Trustee Petrow commented on the grant application and the Village's decision to declare the entire property as surplus. She explained the Village will consider all proposals and review the entire property to determine if any portion would be repurposed for public use.
Trustee Borrelli added that the Ordinance gives the Village an opportunity to seek proposals for the Village-owned property and the public process will provide ample time for anyone interested in purchasing the property to submit their proposal. He further noted the Village reserves the right to determine the best use for that location and to reject any or all proposals.
Trustee Savaria asked Trustee Farina for additional clarification regarding her comments that development would negatively impact the surrounding neighbors. Trustee Farina restated her opinion that many of the proposed developments for this site would be negatively impactful to the neighbors and she shared a few of her concerns, including parking, traffic, delivery vehicles, potential liquor license requests, and police services.
Trustee Savaria noted the ordinance authorizes the Village to request for proposals and the board is not looking at any specific proposals at this time, reaffirming the board's right to reject any or all proposals.
Trustee Rossi asked for claiification from Village counsel regarding the language in the ordinance.
Attorney Lamore advised members the Illinois Municipal Code statute authorizes the corporate authorities to convey the real estate when, in the opinion of the corporate authorities, the real estate is no longer necessary, appropriate, required for the use of, profitable to, or for the best interests of the village.
Following discussion, Mayor Ogle called for a vote.
Clerk Schubert called the roll. Ayes: Mayor Ogle; Trustees Borrelli, Leddin, Petrow, Rossi, and Savaria. Nays: Trustee Farina. The motion carried.
TARGETED INCENTIVE PROGRAM APPROVAL - REMOVED FROM CONSENT AGENDA
Trustee Rossi provided a brief overview of the Targeted Incentive Program (TIP), a new economic incentive program to stimulate private investment in key commercial areas of the Village. He reported the goals of the Targeted Incentive Program are to: foster implementation of the Village's Your Franlifort Your Future Comprehensive Plan; encourage business/property owners to expand, rehab, renovate, beautify, or upgrade existing buildings, interior space, and exterior space, including building facades and site landscaping; encourage business/property owners to construct new buildings for commercial or mixed-use development; bridge any financing gaps for private investors to achieve market reasonable rates of return; facilitate the occupancy of vacant space; facilitate the development of undeveloped land; and attract and retain business activity.
Trustee Rossi made a motion (#4), seconded by Trustee Savaria, to waive the First and Second Readings and pass AN ORDINANCE (NO. 3345) ESTABLISHING THE TARGETED INCENTIVE PROGRAM IN THE VILLAGE OF FRANKFORT.

Trustee Petrow acknowledged Community Development Director Schwarz for his efforts with the new program and highlighted how the program will allow the Village to benefit around the goals of fostering the implementation of the Comprehensive Plan and encourage businesses and property owners to expand, rehab, and renovate.
Members discussed the maximum grant award amount of $500,000 for eligible projects and whether parking impact fees were included in the calculation for Village-incurred costs.
Attorney Lamore noted parking impact fees are not explicitly defined in the ordinance before the Village Board for approval.
Mayor Ogle advised members the Targeted Incentive Program and Village-incurred costs will be discussed in further detail at the February 9th Committee of the Whole meeting.

MAYOR'S REPORT
• Mayor Ogle invited the public to attend an informational Open House for the new well and drinking water treatment plant project at the Elsner Road water tower site. The Open House is scheduled for Wednesday, February 16, from 5:00 P.M. to 7:00 P.M. at the Village Administration Building, 432 W. Nebraska Street.
• Mayor Ogle announced the Lions Club will host a family-friendly tailgate and winter sports event on Sunday, February 20, on Breidert Green. Tailgating will take place in the Breidert Green parking lot starting at 10:00 A.M. followed by winter sports at Noon. Contact Village Event Coordinator Sue Lynchey at (815) 469-2177 by Friday, February 18, to reserve your tailgate space.
• Mayor Ogle reported the inaugural Fire & Ice Winter Social event was held on Saturday, January 29. He thanked Village staff for their efforts with the event and the restaurants who competed in the chili cook-off contest.
• Mayor Ogle announced the Village of Frankfort is currently accepting applications for new vendors for the 2022 Frankfort Country Market season. The 2022 season kicks off on Sunday, April 24 and continues through October 30. Applications are available at the Village Administration Building, 432 W. Nebraska Street or on the Village website.
• Mayor Ogle noted in observance of the President's Day holiday on Monday, February 21, Village of Frankfort offices will be closed. The regularly scheduled board meeting will be held on Tuesday, February 22, at 7:00 P.M.
• Mayor Ogle gave a shout out to Village staff for their tremendous efforts with the major snow event last week.
• Mayor Ogle reminded residents Valentine's Day is February 14.
• Mayor Ogle announced Frankfort Restaurant Week will take place February 17-27, 2022 and he encouraged everyone to take part in the event and enjoy specials from the participating restaurants.
BOARD COMMENTS
The Village Board congratulated the Hickory Creek Middle School Cheer for garnering first place in the IESA State Cheerleading Championship. Members voiced their appreciation to Village staff and the Police Department for their efforts with the recent heavy snow event and helping the community during the inclement weather. Members also gave a shout to Fat Rosie's who won first place in the chili cook-off at the Fire & Ice Winter Social event and welcomed Clerk Schubert's parents who recently purchased a home and will be moving to Frankfort. Members praised the community for rallying around the "Love for Maggie" fundraising campaign to help support Maggie, a kindergartner at Grand Prairie, who was diagnosed with a rare, aggressive, and inoperable brain tumor.
VILLAGE ADMINISTRATOR REPORT
Administrator Piscia provided additional clarification for the Targeted Incentive Program regarding calculations for incentives as they relate to hard and soft costs incurred by the Village. He extended his congratulations to the Hickory Creek Middle School Cheer Team on their state championship. Administrator Piscia advised residents to avoid shoveling or blowing snow from driveways into the roadway and to remove parked vehicles from Village streets during snow events. He also noted the dangers of kids playing in snow forts close to the roadway.
POLICE DEPARTMENT REPORT
Chief Chelepis reported the latest edition of the Frankfort Police News is available on the Village website and she provided some crime statistic data from the newsletter. She encouraged residents to remain vigilant with the #9PM Routine Campaign and continue locking their vehicles and removing keys and key fobs from the vehicle.
VILLAGE ATTORNEY'S REPORT
Village Attorney Lamore had no report.
OTHER BUSINESS
Trustee Petrow asked for further clarification regarding the Targeted Incentive Program as it relates to parking fees and Village-incurred costs. Attorney Lamore noted the Village currently does not have a parking impact fee policy and the board has the option to consider defining these costs and implementation in the future.
PUBLIC COMMENT
No public comments were addressed to the Village Board.
