Village of Frankfort Village Board met Nov. 15.

Mayor Keith Ogle called the regular meeting of the Frankfort Village Board to order at 7:06 P.M.
Village Clerk Katie Schubert called the roll. In attendance were Mayor Keith Ogle, Clerk Katie Schubert, Trustees Adam Borrelli, Margaret Farina, Michael Leddin, Jessica Petrow, Daniel Rossi, and Gene Savaria. Also in attendance were Attorney George Mahoney, Attorney Hannah Lamore, Attorney Jim Murphy, Village Administrator Rob Piscia, Asst. Village Administrator John Burica, and Police Chief Leanne Chelepis.
APPROVAL OF SPECIAL ORDERS - UNANIMOUS CONSENT AGENDA
All items on the Omnibus Agenda are considered to be routine in nature and are enacted in one motion. There is no separate discussion of these items unless a board member makes a request, in which event, the item will be removed from the Consent Agenda and will be considered separately.

1. Traffic Code Ordinance Amendment, Chapter 71: Traffic Control Schedules - No Parking on Sauk Trail between Ash Street and Center Road

Accept the recommendation of the Committee of the Whole, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3325) AMENDING THE VILLAGE OF FRANKFORT CODE OF ORDINANCES, TITLE VII: TRAFFIC CODE, CHAPTER 71, TRAFFIC CONTROL SCHEDULES, to reflect the posting of "No Parking" signage on north side of Sauk Trail between Ash Street and Center Road.
2. Vehicle Replacement Purchase Approval - Resolution
Accept the recommendation of the Committee of the Whole and adopt A RESOLUTION (NO. 21-43) AUTHORIZING THE EXECUTION OF A CONTRACT WITH CURRIE MOTORS OF FRANKFORT FOR THE PURCHASE OF A 2022 FORD EXPLORER, in an amount not to exceed $42,000.00.
3. Disposal of Surplus Vehicles - Ordinance
(Waive 1st and 2nd Readings)
Accept the recommendations of the Operations Committee and the Committee of the Whole, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3326) AUTHORIZING THE SALE OF CERTAIN SURPLUS PROPERTY OWNED BY THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINOIS, disposing of two surplus vehicles via public auction.

2. Orthopedic Bodyworks Special Use for Massage Establishment: 20550 S. LaGrange Road, Suite 230 - Ordinance

Accept the Plan Commission recommendation, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3327) GRANTING A SPECIAL USE PERMIT FOR A MASSAGE ESTABLISHMENT TO CERTAIN PROPERTY LOCATED WITHIN THE LIMITS OF THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINOIS (ORTHOPEDIC BODYWORKS - 20550 S. LAGRANGE ROAD, SUITE 230), to accommodate the operation of Orthopedic Bodyworks, in accordance with the reviewed plans, public testimony, and Findings of Fact.
3. Village of Frankfort Zoning Ordinance Amendment: Articles 7 and 12 - Truck Terminal (Waive pt and 2nd Readings)
Accept the Plan Commission recommendation, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3328) AMENDING THE VILLAGE OF FRANKFORT ZONING ORDINANCE, ARTICLE 7: SITE DEVELOPMENT REGULATIONS AND ARTICLE 12: RULES AND DEFINITIONS, to add a new definition for the term "Truck Tenninal" and replace the tenn "Motor Freight" with "Truck", in accordance with public testimony and the Findings of Fact.
Trustee Farina made a motion (#1), seconded by Trustee Savaria, to approve the Unanimous Consent Agenda.
Trustees Farina, Leddin, Petrow, Rossi, and Savaria presented a brief overview of the consent agenda docket items under consideration for approval.
Mayor Ogle invited trustee comment on the consent agenda docket items prior to a vote being taken. Trustee Petrow commented on parking calculations for personal services and suggested for staff to review the method used to calculate the number of required parking spaces for the category as it relates to shared parking for spa, salon, and massage services.

PLAN COMMISSION REPORT SUMMARY - REMOVED FROM CONSENT AGENDA
MAYS RESIDENCE ACCESSORY STRUCTURE VARIANCE: 7403 MAYFIELD DRIVE - ORDINANCE
Trustee Borrelli presented a brief overview of the accessory structure variance request for the property located at 7403 Mayfield Drive. He reported the applicant requests the granting of an accessory structure variance from 144 square feet to 1,363 square feet to permit the construction of a sports court.
Trustee Borrelli made a motion (#2), seconded by Trustee Petrow, to accept the Plan Commission recommendation, waive the First and Second Readings, and pass an Ordinance approving a variation from Article 5, Section D, Part 3, 'k', '2', for maximum size of an accessory structure for an outdoor recreation area to allow 1,363 square feet whereas 144 square feet is permitted for the property located at 7403 Mayfield Drive, in accordance with the reviewed plans, public testimony, Standards of Variation, and the following two conditions: 1) the sports court shall be screened from view along the east property line as proposed on the property survey with landscape materials as listed on the landscape proposal, and along the west property line as approved by staff; and 2) no outdoor illumination of the court shall be installed.
Mayor Ogle invited trustee comment on the matter prior to a vote being taken.
Trustee Savaria stated he was not in support of the variation request, noting sports courts are considered accessory structures which may not exceed 144 square feet unless there is a land hardship. Trustee Rossi voiced concerns relating to lighting of the sports court and the potential adverse impact to adjacent neighbors. Trustee Borrelli voiced concern that the granting of the variance would set a precedence. He suggested to table the item. Trustee Petrow noted staff is currently drafting revised standards and use regulations for accessory structures and uses, and also favored postponing the matter.
Members discussed postponing the matter to allow staff sufficient time to present proposed text amendments relating to accessory structures and uses before determining the final disposition of the variance application.
Trustee Borrelli made a motion (#3), seconded by Trustee Petrow, to postpone the motion for the variation request until the January 18th Village Board meeting.

ZONING MAP AMENDMENT (REZONING) FROM I-I/LIMITED INDUSTRIAL TO R-4/ ATTACHED SINGLE FAMILY RESIDENTIAL: 300 S. MAPLE STREET - ORDINANCE
Mayor Ogle reported a motion was made at the previous Village Board meeting to lay the question concerning the proposed zoning map amendment (rezoning) of the property located at 300 S. Maple Street on the table until the next Village Board meeting on November 15, 2021 and directed staff to explore ifthere was any common ground to resolve issues. He noted staff has initiated the process and acknowledged the process will take some time.
Mayor Ogle stated BorgWarner provided a written protest to rezone the property which by statute requires an affirmative vote of four trustees to approve and pass the rezoning of the property to R 4. He noted the Mayor does not vote in this instance. Mayor Ogle asked for a motion from the floor to take matter from the table and move to postpone until the December 6, 2021 Village Board meeting.
Trustee Savaria voiced concern relating to the timing of the negotiations and ensuring the discussions are productive. Village Attorney Jim Murphy explained BorgWarner is amenable to continued discussions with the Village and he envisioned the Village Board having some direction regarding the matter in a timely manner.
Trustee Farina made a motion (#4), seconded by Trustee Savaria, to take from the table the matter concerning the proposed zoning map amendment.
Mayor Ogle invited comment on the item prior to a vote being taken. No comments were forthcoming.

MAYOR'S REPORT
• Mayor Ogle entertained a motion from the floor to promote "Small Business Saturday" in the Village of Frankfort on the Saturday after Thanksgiving as a day to shop small and shop local for the upcoming holiday season.
Trustee Savaria made a motion (#6), seconded by Trustee Farina, to proclaim Saturday, November 27, 2021, as "Small Business Saturday" in the Village of Frankfort. A voice vote was taken. All were in favor. The motion carried.
• Mayor Ogle announced the following upcoming events: Lighting of the Green (December 2); Midnight Madness (December 1 O); and Reindeer on the Green (December 11).
• Mayor Ogle noted the Village of Frankfort won the award for "Best Downtown" and recognized as one of the "Best Places to Live" from the 2021 The Times Southland's Best Living series.
• Mayor Ogle congratulated the Lincoln-Way East Griffins football team on a great season.
• Mayor Ogle commented on the generosity of the community for its donations of leftover Halloween candy which was distributed to the Will County Children's Advocacy Center and the Manteno Veterans Home.
BOARD COMMENTS
The Village Board wished Trustee Petrow a happy birthday.
Clerk Schubert wished everyone a happy, safe Thanksgiving.
Trustee Leddin wished a happy, belated Veteran's Day to Trustee Savaria and everyone a happy Thanksgiving.
Trustee Savaria wished everyone a happy Thanksgiving.
Trustee Farina thanked staff and voiced her gratitude for their hard work and dedication to the community. She wished everyone a happy Thanksgiving.
Trustee Petrow gave a shout out to the Frankfort Girls Scouts on their Family Turkey Trot in downtown Frankfort that took place on November 13 and congratulated them for collecting food for the Frankfort food pantry. She commented on the holiday season and voiced her excitement for the upcoming holiday season and events. She wished everyone a happy Thanksgiving.
Trustee Borrelli extended his congratulations to the Lincoln-Way East football team on an outstanding season. He wished everyone a happy Thanksgiving and also voiced his anticipation for the upcoming holiday season.
Trustee Rossi complimented staff for their efforts regarding repairs on a water tank and no disruption in water services provided to residents. He complimented his granddaughter on her excellent performance in the musical production of Freaky Friday at Lincoln-Way East as well as the entire cast and teachers.
VILLAGE ADMINISTRATOR REPORT
Administrator Piscia encouraged residents to keep their leaves piled on the parkways to avoid clogging the streets' stormwater inlets. He reminded residents that the Village will provide one final branch collection on Monday, November 29. He extended happy birthday wishes to Trustee Petrow. He also wished his mom and dad a happy birthday, noting his mom celebrated her 80th birthday yesterday and his dad turns 80 today. He concluded by wishing everyone a happy Thanksgiving.
POLICE DEPARTMENT REPORT
Chief Chelepis provided several safety tips for residents who plan to travel during the holiday season and noted residents can submit a "Vacation House Watch" request to the Frankfort Police Department. She wished Trustee Petrow a happy birthday and extended happy and safe Thanksgiving wishes to everyone on behalf of the Frankfort Police Department.
VILLAGE ATTORNEY'S REPORT
Village Attorney Lamore had no report.
OTHER BUSINESS
There were no other items of business for discussion.
PUBLIC COMMENT
No public comments were addressed to the Village Board.
ADJOURNMENT TO EXECUTIVE SESSION
Trustee Borrelli made a motion (#7), seconded by Trustee Savaria, to adjourn to Executive Session to discuss probable or imminent litigation pursuant to 5 ILCS 120/2(c)(l 1).
Mayor Ogle invited comment on the matter prior to a vote being taken. Trustee Farina asked why the Village Board was going into closed session if the Village is negotiating with BorgWarner regarding the proposed rezoning. Attorney Mahoney explained that pursuant to the Illinois Open Meetings Act, the Village Board can meet in closed session for litigation matters when the public body finds an action is probable or imminent.
Clerk Schubert called the roll. Ayes: Trustees Borrelli, Farina, Leddin, Petrow, Rossi, and Savaria. Nays: None. The motion carried.
The Village Board adjourned to Executive Session at 7:50 P.M.
The Village Board came out of Executive Session at 9:35 P.M. and resumed the regular board meeting.
No action was taken as a result of the Executive Session.
ADJOURNMENT
Hearing no further business, Trustee Farina made a motion (#8), seconded by Trustee Savaria, to adjourn the regular board meeting of Monday, November 15, 2021. A voice vote was taken. All were in favor. The motion carried. The meeting adjourned at 9:35 P.M.
