VI. NEW BUSINESS CORRESPONDENCE

1. USACE DUPAGE RIVER FLOOD MITIGATION PROJECT

Scott Killinger said with the Army Corps of Engineers DuPage River Project, we are moving forward on that.

I’ve said this before, but it’s taking some time. We need to purchase the buyout properties and also we need some easements so that the Army Corps can come in and do elevation and flood-proofing.

So, we need to bring a consultant on board that can do the negotiating of the value of the buyout properties. It’s similar to buying right-of-way for a highway project, but the Army Corps has a specific set of rules.

Land Use Staff is working right now to put together a way to get a consultant. We have a couple different avenues that we’re working. We expect to have that consultant approved at the November County Board Meeting.

Then after that, the Army Corps and Will County Land Use Staff will begin meeting with the individual homeowners and the individual residents.

Most of these people know who they are already. In fact, they’re asking us actively, when are you coming?

In summary, we’re in the process of hiring some additional specialty work and then we will begin meeting with the residents.

If we get that contract approved by the County Board in November, it’s possible we would meet with the individual residents before the Holidays.

I meet about once a week with Imad. I told him this month there’s really nothing for you to come and say, I can explain where we’re at. Once we actually get moving, I’ll probably have Imad actually come in and update from his perspective.

Any questions on the Army Corps project?

Imad Samara from the Army Corps of Engineers said I think I am here too if someone wants to ask me a question.

Scott Killinger said ok, so you are here too. Imad, do you have anything to add? I didn’t know you were there.

Imad Samara said no. I’m just saying I’m here if someone has a question. The sooner that we can get that firm on board, the sooner that we can meet and the sooner that we can start the process. Brian and Scott have really been helping a lot on this and I appreciate it.

Jonathan Dykstra said thank you Imad.

VII. CONSENT AGENDA

CONSENT AGENDA:

1. 2021 Project Program Discussion Itemized Budget for Will County Storm Water Management Committee 2021.

2. Support of the Rock Creek Watershed Based Plan and partial funding of the local match required for IEPA Section 319(h) Grant.

Scott Killinger said there’s a Consent Agenda with four Resolutions on it.

One of them is the Rock Creek Watershed Plan, which we talked about in June. The consensus was that we should pass it, but we lost a Member during the meeting so we didn’t have a quorum and we were unable to do it. Then, we have not had a quorum until today. So, the support for the Rock Creek Watershed Plan is one of them. That one, we are pledging $25,000 towards what’s required for the local match. The IEPA will then put in money for the remainder.

There are three additional projects from our 50/50 program.

There are two from New Lenox Township. I know sometimes we don’t give two projects to the same agency, but we’re not really getting a lot of applications. So, I was talking with the Highway Commissioner in New Lenox and those are definitely going to have a benefit to a couple of County neighborhoods there. I think these are both good projects unless someone objects.

The last Resolution is for an additional project in the City of Joliet that Mike Todorovic and I have been working on. That one actually benefits a City of Joliet resident and a County resident and it’s a small project. Joliet does have another project, so again, we’d be giving two projects to Joliet and two to New Lenox Township.

I can answer questions about the projects if you have any.

Theresa O’Grady said attached to the Agenda there was a tentative project list for 2021. I’m looking at that one right now, is that what you’re talking about?

Scott Killinger said I’m going to read off the projects that are on the Consent Agenda. There’s a Resolution in support of the Rock Creek Watershed Based Plan. Again, we talked about that in June and at that time everybody was okay with it. Obviously, you can rethink that if you wish.

Resolution 21-07 is a Joint Funding Agreement with New Lenox Township to do some work in Edison Industrial Condominium and Cedar Industrial Subdivision. This is drainage maintenance and is basically getting out some storm sewer and getting the drainage system there so it will work and not pool up in the streets and the yards.

There’s a Joint Funding Agreement with the City of Joliet for Pilcher Park Farms Subdivision. This is one where there is water pooling in the rear yard of a couple of residences. It’s right on the line between the City of Joliet and the County. Basically, the City of Joliet Public Works is willing to do the work and the Stormwater Committee is going to buy the material. That way we will have a 50/50 project to help the residents and take care of the standing water.

Mike Todorovic from the City of Joliet said I think the City has decided that we might go to entirely contractual services to complete the work. I just wanted to point that out to everybody and just make sure that there’s no issue with that.

Scott Killinger said okay, that’s fine. We would then just pay half of the contract cost. Mike Todorovic said okay, great. I can answer any other questions if anybody has some. Scott Killinger asked, does anybody have any questions on that Joliet one?

Theresa O’Grady said Scott, maybe I’m missing it, but I’m looking at the Agenda that was sent out, and I went to the web version of the Agenda. I see the Resolution for Rock Creek, but I’m not seeing any other Resolutions attached.

Dawn Tomczak said Resolutions were not attached, because the dates were wrong. So, those need to be amended with this meetings date. That is why the supporting Resolutions were not included.

Theresa O’Grady asked, is there a way to share those on the screen?

Scott Killinger said okay Theresa, we’re going to pull them all up. Rock Creek is coming first.

Theresa O’Grady said okay. I think that one was attached, because I’ve seen that one. Scott Killinger said okay, we’ll skip that one, unless someone else wants to see it.

This one is 21-07. That one is the Edison Industrial Condominium and the Cedar Industrial Subdivision Drainage Maintenance Project. The amount on that one is $25,000. It’s a $50,000 project.

Theresa O’Grady said okay.

Scott Killinger asked, any questions on that one in particular?

No response.

Scott Killinger said the next one is 21-08. This one is for Pilcher Park, the one for the City of Joliet and the County. The amount on that one is $3,000. Mike, we can talk about that because there’s more money in the budget. I can have the Committee change it or we can request that the Committee increase it if we need to, now that you’re going contract work. For now, we’ll get this going.

Mike Todorovic from the City of Joliet said sure, we can talk offline about that.

Scott Killinger said yeah, we can talk offline about that. Any questions on this one in particular?

No response.

Mike Todorovic from the City of Joliet asked, are these going to be posted or distributed to the group once they’ve been amended? How do we get our copy of these?

Scott Killinger said we can distribute them to the group. I can send them to you by email today, but they’re not going to be signed. The way we’re doing this is, once the Committee passes them, we send them to Jon. Jon signs them and then they go by snail mail to Randy. Randy will sign them and then Randy sometimes just drives them over or they come by snail mail. It’s kind of a tedious process. Normally, if we were all in the same room, I would just have them sign them right there, but it’s not that simple.

Mike Todorovic said okay, that works.

Dawn Tomczak asked, who would like a signed copy?

Scott Killinger said Member Weigel is here in the room and he’s asking that we send out an unsigned copy. Dawn, you and I can do that as soon as I get back to the office.

Dawn Tomczak said okay.

Scott Killinger said the last one is 21-09, New Lenox Township. This one is Walona Meadows Unit 1 and New Lenox Heights Unit 1 Subdivision. This project is one that is right along Route 30. The Village of New Lenox is putting in a gas station project just down from this. The Township Highway Commissioner was able to negotiate with them to oversize one of the storm sewers. Now he is going to put some tile in and hook up to that system, which will alleviate some flooding in these neighborhoods. I used to be the Village engineer in New Lenox and I can tell you that this will be a great benefit to these neighborhoods. The amount on this one is $20,000 and it’s a $40,000 project.

Is there any questions on that? If not, then I will summarize where we’re at with the entire budget.

Theresa O’Grady said that’s what I was going to ask, where are we at with all of what we’re spending? How does the overall budget look?

Scott Killinger said you’re reading my mind. We have $150,000 budgeted for the 50/50 projects. Including these projects, to date we will have obligated $133,000. So, we still have a little bit of money left. If somebody else knows of a project, get in touch with Dawn or myself.

I believe we may have a couple more coming in. One may be coming in from Wheatland Township, but it didn’t get here so we weren’t able to put it on the Agenda.

We can award another project in November and then in December, we probably need to start paying them.

Just to remind everybody, the work needs to be done in the Fiscal Year. So, if you did work this summer that would be eligible, especially with COVID. We’re not getting a lot of requests so I’m counting it. As long as it’s within the Fiscal Year, we can approve it and pay it.

Theresa O’Grady asked, do you have an updated list then?

Scott Killinger said I do. I don’t know if I have that online. I can just send that out to you. I think I might have that on the N Drive, but I can’t remember.

Theresa O’Grady said okay.

Mike Todorovic from the City of Joliet said just to confirm, all of the eligible reimbursement expenses need to be expended this Fiscal Year, correct?

Scott Killinger said yes. The Fiscal Year runs from December 1, 2020 to November 30, 2021. So, all of this would have to be expended by November 30, 2021. So, you have a couple of months still.

Mike Todorovic from the City of Joliet asked, do our requests for reimbursement need to be in by the end of the Fiscal Year as well, or can those lag?

Scott Killinger said we like to try to pay in December, but we can still pay stuff in January. In other words, you have to do the work and then after that it’s submitted for payment.

Mike Todorovic said thank you.

Scott Killinger said Theresa, we’re showing the summary of the projects on the screen for you now. On May 4th, we awarded to Crest Hill and Lockport. On June 1st, we awarded to Monee, Wilmington Township and the City of Joliet. On October 5th, I’m recommending that you award the Rock Creek Watershed Plan, a project to New Lenox Township, a project to the City of Joliet, and a project to New Lenox Township. Then the total is $133,000.

Theresa O’Grady said excellent. You don’t know of any other projects out there at this point?

Scott Killinger said there may be a project coming from Wheatland Township. Actually, he is here in the room so afterwards I’m going to work with him a little bit. If he gets that to me in November, then I’m going to have that on a Consent Agenda for November and then hopefully we’ll have obligated the whole $150,000.

The County Board gives us this money to fix problems that the residents have. My job as Staff is to make every effort to help the residents by spending the money.

Theresa O’Grady said so the balance is $17,000. Is that what the Wheatland Township one would be? You’re thinking with that we’d get to the $150,000?

Scott Killinger said I’m thinking with that one we’d get to $150,000.

Theresa O’Grady said okay.

Jonathan Dykstra asked, any more questions for Scott?

Theresa O’Grady made a Motion to approve the Consent Agenda. Ken Carroll seconded the Motion.

Bill Lamb made a Motion to use previous Roll Call. Theresa O’Grady seconded the Motion. Voice Vote was taken. Motion passed unanimously, 10-0.

VIII. REPORT OF OFFICERS, SUBCOMMITTEES, STATE'S ATTORNEY AND/OR STAFF

Scott Killinger said in November Marilyn Sucoe has requested to be placed on the Agenda. I told her of course, you’re always welcome to come. She hasn’t told me what the topic is. I anticipate having a meeting and I suppose it will be like this, virtual. Marilyn Sucoe will be on there and then we will talk about the projects. Potentially we’ll have another project from Wheatland Township to approve.

There are vacancies on the Committee. Just so everyone understands, the County Board is currently re-districting. So, there’s no reason to fill any of the spots up until that’s complete. Dawn and I are aware that there’s vacancies and we’ve talked to the County Executive’s Office about it. The reality is, until the Board is re-districted, there’s no reason to appoint anyone.

Everyone here is probably aware, the MS4 Permit has been reissued and it’s on the IEPA website. It was there for public comment and I believe that public comment period has closed. If you are the MS4 person in your community and you have questions, you can reach out to me or you can go onto the IEPA website. I have a feeling anybody that’s involved in that probably already knows, but I want to call it to your attention.

Jonathan Dykstra said I think that time period ended on October 1st, or thereabouts.

Scott Killinger said I know part of what’s in there is that you’re going to have to file a new Notice of Intent. Whenever this takes effect, that’s going to be the big thing, you’re going to have to redo your Notice of Intent. There are some changes in there, it’s not just all the same stuff. I’m not really prepared to go down a list this morning, but there are some changes in there. You may just want to take a look at it.

Jonathan Dykstra said the final version that comes out from Springfield may even change a little bit from what was in that Public Notice, based on comments. They typically will look through comments they receive back from municipalities. So, there could be a few more little changes. We’ll have to see what the final is. It usually doesn’t change a lot. There’s really no point in listing the changes until they make the final.
