Village of Plainfield Plan Commission met April 2.

CALL TO ORDER, PLEDGE, & ROLL CALL

Chairman Kiefer called the Plan Commission meeting to order at 7:00 p.m. and led the pledge to the flag.

ROLL CALL: Commissioners Heinen, Renzi, Ruane, Seggebruch, Womack and Chairman Kiefer were present. Commissioner Womack was absent. Plainfield Fire Protection District was present. Plainfield Public Library District, Plainfield Township Park District and Plainfield Community Consolidated School District 202 were absent.

OTHERS PRESENT: Jonathan Proulx, Director of Planning; and Yuchen Ding, Associate Planner.

APPROVAL OF MINUTES PUBLIC COMMENTS

Chairman Kiefer asked for public comment and there was no response.

DEVELOPMENT REPORT

OLD BUSINESS

Case No. 1814-081318.AA.SU.PP East side of Steiner Rd. Edward Mattox between 143rd St. & Rte. 126

Commissioner Ruane made a motion to continue the case and public hearing to the April 16, 2019 Plan Commission meeting.

Seconded by Commissioner Minnis. Vote by roll call: Seggebruch, yes; Ruane, yes; Womack, yes; Renzi, yes; Heinen, yes; Minnis, yes; Kiefer, yes. Motion carried 6-0.

NEW BUSINESS

Case No. 1830-021619.AA 16417 S. Forest Edge Dr. Angela Krueger Mr. Ding stated the applicant is seeking to annex the subject parcel in unincorporated Will County, east of South Forest Edge drive and west of DuPage River, into the Village of Plainfield. The parcel is currently improved for residential use with a one (1)-story/ranch with three (3) separate apartments, paved parking lot, and a septic tank. Mr. Ding added the subject site at 16417 South Forest Edge Drive is approximately 1.77 acres (71,101.2 square feet). The parcel is improved with a multi-unit residential building of approximately 3,113 square feet, a paved parking lot, and a one thousand-gallon septic tank at the back of the house. The subject parcel is contiguous to the Village of Plainfield’s municipal boundary via the existing Village boundary south of the parcel.

Mr. Ding reviewed the staff report dated March 29, 2019. Mr. Ding concluded staff believes the proposed annexation is a logical extension of the Village’s boundaries. Prior to any public comment and discussion by the Plan Commission, staff recommends approval.

Chairman Kiefer swore in John Argoudelis, attorney; and Angela Krueger, applicant. Mr. Argoudelis stated Ms. Krueger was informed by Will County the multi-tenant use is non-conforming. Mr. Argoudelis indicated the multi-tenant use has been this way for a long time and the applicant would like to continue using the property that way.

Chairman Kiefer asked for public comment and there was no response.

Commissioner Renzi asked what engineering issues the property has. Ms. Krueger stated she is not aware of any engineering issues. Mr. Ding indicated currently there are no clear engineering issues. Commissioner Renzi asked staff if the non-conforming use would terminate if the applicant sold the property. Mr. Proulx stated the Village code states the use stays with the property but stated if the structure is demolished the owner may not be able to build a multi-tenant structure. Mr. Proulx stated staff is comfortable with this situation since the parcel has been used this way for decades and because of the size of the parcel.

Commissioner Ruane asked for clarification on the size of the property, since 2 acres would be subject to additional improvements. Mr. Ding stated the survey includes the right-of-way. Ms. Krueger indicated the survey includes the right-of-way and a portion on the river. Commissioner Ruane stated he would agree the property is under 2 acres.

Commissioner Seggebruch asked the applicant how long she owned the property. Ms. Krueger stated she purchased it in October of 2007. Commissioner Seggebruch asked if the structure was already divided into 3-units. Ms. Krueger confirmed. Commissioner Seggebruch asked the applicant to explain the layout of the structure. Ms. Krueger proceed to described how the structure is divided into the 3-units. Commissioner Seggebruch asked if the structure has a basement. Ms. Krueger stated the basement is under the unit that she occupies. Commissioner Seggebruch asked if all the units are occupied. Ms. Krueger indicated that there is one vacant unit. Commissioner Seggebruch expressed his issues which include; coming to the Village to avoid problems with the County, if all three units were to ever become rentals, and that the non-conformity does not end if property is sold. Commissioner Seggebruch believes that the owner currently living in one of the units and amount of open space on the property is a plus.

Commissioner Ruane made a motion to recommend approval of the annexation of the parcels commonly known as 16417 South Forest Edge Drive (Parcel Identification Number 06-03-20-400-008-0000), as a logical extension of the Village of Plainfield.

Seconded by Commissioner Minnis. Vote by roll call: Heinen, no; Renzi, yes; Seggebruch, yes; Minnis, yes; Ruane, yes, Kiefer, yes. Motion carried 5-1.

Case No. Will County Case 12019 S. Spaulding School Dr. Peironi Motors Inc.

Mr. Ding stated the petitioner is seeking approval from Will County for a special use permit to allow for light equipment sales in order to establish an internet-based used car dealership. According to the Will County Zoning Code, a light equipment sales/rental business under the Vehicle and Equipment Sales and Service category in I-1 Limited Industrial zoning district would require a special permit. Mr. Ding added the subject property consists of a three (3)-unit building for light industrial businesses and a paved parking lot on approximately 0.8 acre, located on the east side of South Spaulding School Drive in the northern part of the Wolf Creek Industrial Park.

Mr. Ding reviewed the staff report dated March 29, 2019. Mr. Ding concluded staff submits that the proposed special use for 12019 South Spaulding School Drive will not adversely affect the character of nor the development in the industrial park. The location of the subject property is also in keeping with the Village’s Comprehensive Plan, which has designated this area as light industrial/business park. Therefore, staff does not recommend objecting to this case.

Chairman Kiefer swore in the applicants, James Peironi and Angela Monday. Mr. Peironi explained that they currently sell auto accessories but need a special use to get a dealer’s license from the State.

Chairman Kiefer asked for public comment and there was no response.

Commissioner Minnis asked the applicant if they occupy only one unit in the building. Mr. Peironi confirmed. Commissioner Minnis asked if there will be auto repairs. Mr. Peironi stated no.

Commissioner Renzi asked for clarification if the commission will need to take action. Chairman Kiefer explained that the County will be taking the action and the Village is providing feedback at this time. Chairman Kiefer indicated that the commission can take action with a motion of support or of objection. Mr. Proulx stated legally since this use special is within a mile and a half of our Village we can object to the application if we do not support it. Mr. Proulx further explained that if the Plan Commission objects, a motion can be made asking the Village Board to object to the application. Commissioner Renzi suggested making a motion either way. Chairman Kiefer agreed.

Commissioner Seggebruch asked if there are any adjacent properties in the Village next to this parcel. Mr. Proulx stated he does not believe so.

Commissioner Ruane made a motion that the Plan Commission does not object to the special use request.

Seconded by Commissioner Heinen. Vote by roll call: Minnis, yes; Renzi, yes; Seggebruch, yes; Heinen, yes; Ruane, yes, Kiefer, yes. Motion carried 6-0.
