Newly passed bill authored by State Sen. Michael E. Hastings seeks to strengthen enforcement of fire sprinkler licensing by increasing civil penalties for unlicensed contractors and inspectors after winning approval in both chambers, according to the Illinois General Assembly.

In the House, 75 Democrats and 39 Republicans voted in favor of the bill.

Meanwhile, in the Senate, 39 Democrats and 16 Republicans voted in favor of the bill.

Hastings introduced the bill in the Illinois Senate on Feb. 7, 2025 during the 104th session.

The legislation, known as SB2303, was passed on May 28, 2025 during the general assembly session 104.

According to the Illinois General Assembly site, the legislature summarized the bill's official text as follows: "Amends the Fire Sprinkler Contractor Licensing Act. Provides that any person, entity, or business that offers fire sprinkler contractor services under the Act without being licensed or exempt under the Act shall pay a civil penalty in an amount not to exceed $50,000 (rather than $10,000) for each offense. Provides that, if any person, entity, or business commits a second offense within 24 months, the civil penalty shall be no less than $10,000 which shall be deposited into the Fire Prevention Fund. Provides that, if any person, entity, or business commits more than 2 offenses within 24 months, the civil penalty shall be no less than $25,000 which shall be deposited into the Fire Prevention Fund. Provides that any person who practices, offers to practice, attempts to practice, or holds himself or herself out to practice as a fire sprinkler inspector without being licensed or exempt under the Act shall pay a civil penalty not to exceed $50,000 (rather than $10,000) for each offense. Provides that, if any person commits a second offense within 24 months, the civil penalty shall be no less than $10,000 which shall be deposited into the Fire Prevention Fund. Provides that, if any person commits more than 2 offenses within 24 months, the civil penalty shall be no less than $25,000 which shall be deposited into the Fire Prevention Fund. Effective immediately."

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, this bill amends the Fire Sprinkler Contractor Licensing Act, increasing civil penalties for unlicensed fire sprinkler contractors and inspectors. Offenders can be fined up to $50,000 per violation. If a second offense occurs within 24 months, the penalty must be at least $10,000, and if more than two offenses occur in the same period, the penalty increases to a minimum of $25,000. The fines are to be deposited into the Fire Prevention Fund. The usage of the title "fire sprinkler inspector" is restricted to licensed individuals only. The bill also allows the office to investigate unlicensed activities and mandates that penalties be paid within 60 days of the order's effective date. The bill is effective immediately upon becoming law.

The bill was sponsored by Rep. Angelica Guerrero-Cuellar (Democrat-22nd District), Sen. Chris Balkema (Republican-53rd District), and Sen. Erica Harriss (Republican-56th District), along with eight other sponsors.

Bills in Illinois follow a multi-step legislative process, beginning with introduction in either the House or Senate, followed by committee review, floor debates, and votes in both chambers before reaching the governor for approval or veto. The General Assembly operates on a biennial schedule, and while typically thousands of bills are introduced each session, only a fraction successfully pass through the process to become law.

Hastings graduated from United States Military Academy at West Point in 2003 with a BS and again in 2014 from The John Marshall Law School with a JD.

Hastings, a Democrat, was elected to the Illinois State Senate in 2013 to represent the state's 19th Senate District, replacing previous state senator Maggie Crotty.
