City of Wilmington City Council met Aug. 6.

Here are the minutes provided by the council:

MAYOR BEN DIETZ CALLED TO ORDER THE REGULAR MEETING OF THE WILMINGTON CITY COUNCIL AT 7:00 P.M.

ROLL CALL

After the pledge of allegiance, the following answered to Roll Call: Alderpersons Kevin Kirwin, Ryan Jeffries, Dennis Vice, Leslie Allred, Jonathan Mietzner, Todd Holmes, and Thomas Smith. Alderperson Ryan Knight was absent. The number present constitutes a quorum.

Also present: City Administrator Jeannine Smith, Public Works Director James Gretencord, Chief of Police Adam Zink, City Attorney Bryan Wellner, and Deputy City Clerk Joie Ziller.

CITIZENS COMMENT

Al Kuyper, representing Hands of Hope provided a project overview at the building located at 660 N. Kankakee Street and is seeking relief from the fire wall requirement.

A resident on Cross Street expressed his concerns related to the neighbor's fence and his easement.

MAYOR’S REPORT

Mayor Dietz thanked the Catfish Days Committee for putting on a great program. Last Saturday our town was host to Sharefest where over 500 families were served and Ski Tournament at Water’s Edge with 500 plus participants and Sunday was Local 150 Picnic attended by over 14,000. On August 15 from 3-6 PM IDOT will host public heating at the Local 150 Training Center for the improvement of I-55 at Lorenzo Road and at IL 129.

CONSENT AGENDA

1. Approve the Regular Meeting Minutes from July 16, 2024

2. Approve the Accounts Payable Report

Alderperson Kirwin made a motion and Alderperson Vice seconded to approve the Consent Agenda for August 6, 2024, as presented

Upon roll call, the vote was:

AYES: 7 Kirwin, Vice, Holmes, Allred, Mietzner, Jeffries, Smith

NAYS: 0

ABSENT: 1 Knight

The motion carried.

ORDER OF BUSINESS

Alderperson Vice made a motion and Alderperson Kirwin seconded to approve the Planning and Commission Recommendation and Approve the request by petitioner Jarrod Briscoe of RT 66 Creamery and recommend to the City Council to approve the implementation of a drive-through and combine PINs 03-17-25-357-001-0000 and 03-17-25-357-004-0000, a conditional use for a drive-through facility, variance for side yard setback to allow 20.13 ft from the required 30 ft and variance for drive-thru of 3.7 ft from required 5 ft along with the following conditions business hours no later than 10 PM, complete the entire parking lot plan including signage at the same time at the drive-thru is being added, a photometric plan approved by City Engineer, add additional fencing and curbing between property lines

Upon roll call, the vote was:

AYES: 7 Vice, Kirwin, Holmes, Allred, Mietzner, Jeffries, Smith

NAYS: 0

ABSENT: 1 Knight

The motion carried.

Alderperson Mietzner made a motion and Alderperson Allred seconded to approve the Contribution to the Wilmington School District 209-U Foundation for Excellence Scholarship Fundraiser by making a $500 Lunch Sponsorship Donation

Discussion: Mayor Dietz asked if there was consideration to make a larger donation, perhaps $2,500. Attorney Wellner informed the Council that action needs to be taken on the made motion and then another motion can be made

Upon roll call, the vote was:

AYES: 2 Mietzner, Smith

NAYS: 5 Allred, Jeffries, Kirwin, Vice, Holmes

ABSENT: 1 Knight

The motion was denied.

Alderperson Smith made a motion and Alderperson Jeffries seconded to approve the Contribution to the Wilmington School District 209-U Foundation for Excellence Scholarship Fundraiser by making a $1,000 Donation

Upon roll call, the vote was:

AYES: 4 Smith, Jeffries, Mietzner, Allred

NAYS: 3 Kirwin, Vice, Holmes

ABSENT: 1 Knight

The motion carried

REPORTS AND COMMUNICATION FROM CITY OFFICIALS

City Attorney – Bryan Wellner – Introduced Attorney Matthew Moustis who has been at the firm for about a year and practicing municipal law and Law Clerk Jessica Leisure who has been interning this summer.

City Administrator – Jeannine Smith – This morning representatives from Pace Paratransit were at City Hall for photo opportunities so some PR will be going out shortly. A letter from the IDNR regarding the replacement of the Kankakee Street Bridge over Forked Creek.The RFP for cleaning services will be issued on September 8th.

Finance Director – Nancy Gross – No Report

Public Works Director – James Gretencord – Contractors for the MFT road program began mobilizing yesterday.

Chief of Police – Adam Zink – No Report

Alderperson Allred made a motion and Alderperson Mietzner seconded to go into Executive Session at 7:25 PM to discuss Probable or Imminent Litigation and Pending Litigation [ILCS 2(c)(11)]

Upon roll call, the vote was:

AYES: 7 Allred, Mietzner, Holmes, Jeffries, Kirwin, Vice, Smith

NAYS: 0

ABSENT: 1 Knight

The motion carried.

Alderperson Allred made a motion and Alderperson Kirwin seconded to close Executive Session at 7:45 PM

NAYS: 0

The motion carried.

The motion to adjourn the meeting was made by Alderperson Mietzner and seconded by Alderperson Jeffries. Upon the voice vote, the motion carried. The City of Wilmington City Council's regular meeting on August 6, 2024, adjourned at 7:48 p.m.
