Village of Manhattan Board of Trustees met April 16.

Here are the minutes provided by the board:

A Regular Meeting of the Village of Manhattan President and Board of Trustees was held on Tuesday, Mapril 16, 2024.

CALL TO ORDER:

Mayor Adrieansen calls the Village of Manhattan Board meeting to order at 6:00 P.M.

ROLL CALL:

Neighbors aye, Young aye, Dilling absent, Beemsterboer aye, Adamski aye, Doyle aye, Adrieansen aye (6 ayes, 0 nays, 1 absent). Also present are Lewis, Palmer, Nelson, Pintar, Wold, Doyle, and Attorney Taylor.

PUBLIC HEARING/RECOGNITIONS/SPECIAL ITEMS:

There are no Public Hearing/Recognitions/Special Items.

PUBLIC COMMENT:

There is no public comment.

CONSENT AGENDA:

Young Motion to Approve the Consent Agenda which consists of the April 2, 2024, Village Board Meeting Minutes; April 2, 2024, Executive Session Meeting Minutes (Not for Release); and Approval of April 16, 2024, Bills List. Doyle Second. Roll Call: Neighbors aye, Young aye, Dilling absent, Beemsterboer aye, Adamski aye, Doyle aye (6 ayes, 0 nays, 1 absent, 0 abstain) Motion Carried.

NEW BUSINESS:

Mayor Adrieansen informs the Board of Trustees that the first item on the agenda is a Resolution Authorizing the Village of Manhattan, Will County, Illinois to Enter Into an Intergovernmental Jurisdictional Boundary Line Agreement with the Village of Frankfort, Will County, Illinois. The previous boundary agreement between Manhattan & Frankfort has expired. This item is the renewal of the boundary agreement between our two communities and will extend the boundary line for another 20 years to 2044. These agreements are important for long-term planning & provide stability for the two communities with an agreed planning area. This renewal took a bit longer due to some corrections with the maps in Wilton Township. This was done to keep the lines consistent between municipalities.

Doyle Motion to Approve a Resolution Authorizing the Village of Manhattan, Will County, Illinois to Enter Into an Intergovernmental Jurisdictional Boundary Line Agreement with the Village of Frankfort, Will County, Illinois. Adamski Second.

Beemsterboer asks Attorney Taylor about paragraph nine of the agreement. Beemsterboer states that he was under the impression that when we did Elwood’s agreement we were changing this paragraph in all agreements. The right to disagree.

Dilling arrives at 6:04 P.M.

Attorney Taylor states that he does not recall any discussion about changing paragraphs 9a and 9b. There were modifications made to this agreement in keeping consistency to the one that was done in Elwood with respect to the 1.5-mile radius.

Beemsterboer states that in the Elwood agreement it specifically states that the Village can object and in the Frankfort agreement it does not state that. Beemsterboer feels that it doesn’t seem right that you have it one way with one side of the border and not the other. Beemsterboer feels they should be the same.

Attorney Taylor informs the Village Board that the item can be tabled allowing him to take the agreement back to Frankfort’s attorney to review the language.

Adamski Amends his Motion to Withdrawal. Roll Call: Young aye, Dilling aye, Beemsterboer aye, Adamski aye, Doyle aye, Neighbors aye (6 ayes, 0 nays, 0 absent, 0 abstain) Motion Carried.

Mayor Adrieansen informs the Village Board that the next item on the agenda is a Resolution Approving a Professional Services Agreement Between the Village of Manhattan and Houseal Lavigne Associates, LLC to Complete the Manhattan Comprehensive Plan Update. The Village previously adopted a Comprehensive Plan in 2008. Usually these are completed every 10 years. The Village release a Request for Qualifications in February 2024. Houseal Lavigne Associates, LLC responded and is well qualified to complete the work. Staff has met with this form and negotiated the contract not to exceed $138,275. The JADA Grant will fund $75,000 of this, so the Village maximum cost is $63,275. Work will begin immediately with staff, with a projected presentation to the Board on June 4th.

Doyle asks if a traffic study will be part of the Comprehensive Plan.

Mayor Adrieansen would like to bring that topic to the Committee of the Whole meeting sometime in May.

Beemsterboer would like to talk to Houseal Lavigne about a traffic study when they come to present the Comprehensive Plan to the Board on June 4th.

The Village Board and Village Staff discussed getting a traffic study done for the Village of Manhattan and surrounding areas. More discussion will take place at a future Committee of the Whole meeting.

Adamski Motion to Approve a Resolution Approving a Professional Services Agreement Between the Village of Manhattan and Houseal Lavigne Associates, LLC to Complete the Manhattan Comprehensive Plan Update. Mayor Adrieansen informs the Village Board that the next item on the agenda is an Ordinance Increasing the Number of Class G Liquor Licenses, Granting a Class G Liquor License to Funseekers, LLC, and Amending Tite 2 (Business Regulations), Chapter 3 (Liquor Control Regulations), Section 2-10 (Number of

Licenses Issued and Automatic License Reduction) of the Manhattan Village Code of Ordinances. With the closure of Roadhouse 52, the liquor license for that business automatically dissolved. The new owners of the property at 525 S. State Street (Funseekers, LLC) are seeking a Class G liquor license. Nick Been is the owner making this request. The new establishment is expected to open in June 2024. This requires board action to increase the existing licenses in this category by one.

Mayor Adrieansen informs the Village Board that the next item on the agenda is an Ordinance Amending Title 8, Chapter 4, Article B-8 (Lawn Sprinkling Restrictions) of the Manhattan Village Code of Ordinances. There is a need to update the Village code to reflect a previous decision to adjust the lawn sprinkling restrictions. There are some different thoughts about the timing of the water restrictions and this item may need to be tabled until the board can agree on what the time of the restrictions should be.

Young would recommend tabling the agenda item. Currently the watering restriction states that you can only water between 7am-11am and 7pm-11pm. Young states that if you know anything about watering lawns you know that you should not water that close to nightfall because you can get fungus. Most recommend you water between 4am-6am before the sun comes up. Young has an automatic sprinkler system that is set to automatically water and based on the restrictions he would be in violation. Young proposes that the watering times be set to 7pm-11am.

Mayor Adrieansen informs the Village Board that the next item on the agenda is an Ordinance Amending Title 8, Chapter 4, Article D (Cross-Connection Control) of the Manhattan Village Code of Ordinances. Staff was reviewing the ordinances for Cross Connection Controls to have more accurate wording. Public Works confirmed the information with IEPA, Illinois Plumbing Code and the Illinois Complied Statutes. The red-lined updates are included in the board packet.

Beemsterboer Motion to Approve is an Ordinance Amending Title 8, Chapter 4, Article D (Cross Connection Control) of the Manhattan Village Code of Ordinances. Young Second. Roll Call: Neighbors aye, Young aye, Dilling aye, Beemsterboer aye, Adamski aye, Doyle aye (6 ayes, 0 nays, 0 absent, 0 abstain) Motion Carried.

Mayor Adrieansen informs the Village Board that the next item is a discussion about Cherry Hill Road. Funding has been allocated in the fiscal year 2025 budget for improvements to Cherry Hill Road only for improving the road. There was no additional funding to deal with stormwater or other related issues. The Village intends to host a public meeting for the residents along the strip of road between Brown and Bruns to review the project. The target date for this meeting on Thursday, May 2nd at 5:00 P.M. Letters to the property owners will go out this week. We want these residents to understand what is planned and to make them aware of the limits of what we can do presently.

The Village Board discusses proposed improvements to Cherry Hill Road and the possible issues that could arise from storm water.

FROM VILLAGE OFFICIALS

Mayor Adrieansen informs the Village Board that the next item is the Authorization to Appoint Erin McDonough to the Manhattan Police Pension Fund for a Two-Year Term Beginning May 1, 2024, and Ending May 1, 2026. Karleen Kendall will be vacating her spot and Erin will be appointed in her place if everyone agrees.

Mayor Adrieansen would like to thank the Police Department for truck enforcement, everything they do in our schools, community events, and investigations. Officer Baez, our Truck Enforcement Officer, recently wrote an overweight ticket for $19,000.00.

Neighbors is happy about the Comprehensive Plan. Neighbors would also like to offer her condolences to Finance Director Gehrke and his family on the recent loss of his mom.

Young asks Police Chief Wold if in the future when billing for Irish Fest can we bill for our salary officers in addition to our hourly officers.

Dilling asks about the lights on Route 52.

Mayor Adrieansen states that ComEd is waiting on the IDOT Permit.

The entire Village Board offers their condolences to Glenn Gehrke and his family for their loss.

Village Clerk Lewis announces that the Village Open House and Touch-A-Truck will take place on Saturday, May 11, 2024, from 11:00 A.M. – 1:00 P.M. with food trucks, face painters, and balloon twisters.

Village Clerk Lewis would like to thank the Village Board and Staff for completing their Statement of Economic Interest forms.

REPORTS FROM VILLAGE STAFF

Monthly Reports for March 2024 in the Board Packet are presented to the Village Board for Finance, Police, EMA, Public Works, Village Engineer, and Building and Development.

Village Administrator Palmer Announcements:

➢ BS&A Meeting are scheduled for tomorrow, April 17th.

➢ Working on the website refresh.

➢ Looking at implementing new software that will help with board agenda management.

Adamski asks what the process in town is with addressing old signs that need to be removed or fixed.

Community Development Director Nelson states that he will make that a priority when they hire the Code Enforcement Officer.

Young asks Community Development Director Nelson if he can address the Dunkin directional sign that has been hanging down for the last few months. Someone hit it.

Police Chief Wold informs the Village Board that traffic stops are down, but criminal activity is up. He feels that is due to the warmer weather starting a little early.

Mayor Adrieansen states that it is Dispatcher Appreciation Week and Chief Wold dropped off some food at the Laraway Communications Center for the dispatchers.

EMA Director Doyle provides the Village Board with a report on Irish Fest. Sixteen towns assisted for a total of 510-man hours.
