A Regular Meeting of the Village of Manhattan President and Board of Trustees was held on Tuesday September 17, 2019. Mayor Doyle opens the meeting at 7:00 P.M. Roll call: Trustee Beemsterboer aye, Trustee Biscan aye, Trustee McDonough aye, Trustee Naughton aye, Trustee Dilling aye, Trustee Doyle Aye. Also present are Becker, Doyle, Kendall, Nelson, Pintar, Sing, Taylor, Tyk and Wazny.
Biscan motion to approve the Consent Agenda With The Amendment Of The Approval Of The Minutes August 20, 2019 To The Regular Minutes of the September 3, 2019, And Bills List For September 17, 2019. Naughton second. Roll call: Beemsterboer aye, Biscan aye, McDonough aye, Naughton aye, Dilling aye, Doyle aye. (6 ayes, 0 nays, 0 absent). Motion Carried.
Village Administrator Sing informs the Mayor and Board of Trustees that they have before them a Request for Authorization To Upgrade the File Server. The Village’s File Server and accompanying switches were last replace in 2014. A lot of changes have occurred technology wise since then; Microsoft no longer supporting Windows 7, Workstation software moved to subscription based with monthly fee. This includes Email, Office and Adobe Standard, Work Station version still available for purchase, however will not receive security upgrades automatically, need to monitor dark web for possible security comprises and protections to safeguard against network breaches. Due to the ever changing IT environment and need to insure all software and hardware security is up to date. In addition to updating our server, we recommend moving to a managed network. By moving to managed network, our vendor will ensure that software and hardware is up to date with the latest security. In addition to providing all of our normal technical support needs, they will also monitor the network to ensure backups are being performed successfully, actively monitor hacker intrusions, and ensure our network is free from viruses and malware. For this project we vetted Tow (2) companies to work with; Andromeda Technology and Dura-Tech. Andromeda is our current vendor and Dura-Tech provides services to other local governments in our area. Both are knowledgeable and able to serve our needs. The companies had different opinions on the specifications for the replacement server. Dura-Tech recommended a more robust server so we could move the video system to it. Dura-Tech upgrade quote is $16,730, and Andromeda is $16,549.63. The Village will also need to replace the switches that all our cabling comes into, at a cost of $26,690. Staff recommendation is that the Village upgrade the file server $16,730, and switches $26,690 with Dura-Tech for a total cost of $43,420.85. While this is $180 more, we will be receiving a server with more memory and processing power. Trustee Beemsterboer would like to know if the Village will have to do this type of upgrade every Five (5) years. Village Administrator Sing informs him that they may have to, they will just have to wait and see how Technology changes over the years. Trustee Beemsterboer would like to know if they could enter some type of leasing for this and would it be cheaper. Village Administrator Sing informs him that they did look into this, but the interest is high on this type of market.

Village Administrator Sing informs the Mayor and Board of Trustees that they have before them An Ordinance Adding A New Chapter 14, Title 2, Of The Village Of Manhattan Code, Will County, Illinois (Kitchen And Cottage Food Operations). We are presenting this Ordinance at the request of a Manhattan citizen, who is present. This Ordinance would allow for Two (2) different types of food preparation in residential kitchens. The Home Kitchen Operation, Illinois Statue 410 ILCS 625/3.6 allows for the preparation of non-potentially hazardous baked foods in a person’s residential kitchen for direct sale by the owner or family member. To qualify the following conditions must be met, Monthly gross sales do not exceed $1,000, the food is non-potentially hazardous baked good, a notice is provided to the purchaser that the product was produced in a home kitchen, the food package is affixed with a label or other written notice is provided to the purchaser that includes; a common or usual name of the food product, allergen labeling s specified in federal labeling requirements by the United States Food Drug Administration, the food is sold directly to the consumer and the food is stored in the residence where it is produced or packaged. Cottage Food Operations, Illinois Statue 410 ILCS 625/4 allows a person to produce or package food or drink in a kitchen located in that person’s primary domestic residence or anther appropriately designed and equipped residential or commercial-style kitchen on their property for dirt sale by the owner, a family member, or employee and is registered with their local health department as a cottage food operator. Food handling training is also required. Cottage food operator is only allowed to sell at farmers markets with one exception. To sell outside of farmers market, the main ingredients must be locally grown.

Village Administrator Sing informs the Mayor and Board of Trustees that they have before them An Ordinance Amending Title 1, Chapter 5, Article 3, Of The Village Of Manhattan Code, Will County, Illinois (Board Meeting Start Time) First Read. At the last Board Meeting it was suggested that future meetings start at 6:30 P.M. Prior to 2014, the Village Board Meeting started at 6:30 P.M.

Village Administrator Sing informs the Mayor and Board of Trustees that they have before them Approval of State Street Auto Invoices Totaling $72.00. Trustee Doyle is the owner of State Street Auto, for the Village to continue using State Street Auto; we followed the Illinois Municipal Code which sets parameters for doing business with elected officials. The Village Executed the final Contract not to exceed $2,000 annually with State Street Auto. If approved the total expended under the extended contract is $72.00.

Assistant Finance Director Kendall informs the Mayor and Board of Trustees that they have before them a Resolution Authorizing An Outstanding Check Policy. The purpose of this policy is to provide a uniform reporting for the Village of Manhattan to follow the State of Illinois, State Statue for unclaimed property. The State of Illinois requires such property to be handed over to the state when the owner has had no contact with the entity for what is referred to a dormancy period now of 3 years. The unclaimed checks will be reported and sent to the State with the owner’s last known address.

Assistant Finance Director Kendall informs the Mayor and Board of Trustees that they have before them for First Read An Ordinance Updating The Investment Policy Of The Village Of Manhattan, Will County, Illinois. The Village’s Investment Policy was adopted in November 1999. Since it has been Twenty (20) years since the original, we felt a revised one was in order. The most crucial objective of the Investment Policy is the maximum safety of the Village’s Funds. This policy update includes defined parameters and objectives such as Credit and Interest Rate Risks, Defining Standards of Care, Safekeeping and Custody, Suitable & Authorized Investments and Investment Parameters. This Ordinance is for First Read and will be brought back at the next Regular Board Meeting in October.
The Mayor and Board of Trustee Review the Public Safety Department Monthly Report and at this time have no questions. Chief Wazny points out that a correction was made to the reference Date and Detective Duffy.

The Mayor and Board of Trustees Review the Monthly Engineer Report and at this time have no questions. Village Engineer Pintar reports that the Gougar Road Project has started and is still on schedule for a completion date of October 28, 2019.

Community Development Director Nelson informs the Mayor and Board of Trustees that they have before them for First Read An Ordinance Amending Title 4, Of Ordinances “Zoning Regulations For The Village Of Manhattan” Amending Off-Street Parking And Loading In The Village of Manhattan, Will County, State Of Illinois for First Read. Currently, the Village’s Zoning Ordinance prohibits the parking of vehicles (automobiles, trailer, camper, ect) in any front yard area except on a regularly constructed driveway. Recently, we have been receiving an increase in the amount of complaints regarding the parking of vehicles in back and side yards in the grass and on patios. In an effort to present a more positive appearance in the Village, Staff is proposing to amend the off-street parking regulations to prohibit the parking of vehicles in the grass and on patios in back and side yards. This Ordinance change would require a regularly constructed driveway which connects to a Village Street, Alley or Access Easement. In order to give residents an adequate amount of time to comply with the proposed Ordinance, it is recommended that the effective date of the Ordinance be made one year from the date of adoption. The Planning and Zoning Commission held a Public Hearing regarding this Ordinance change and has recommended approval. Community Development Director Nelson points out that some of the Trustees do have concerns with the impact this will have on some residence, so they are adding language in regards to extending gravel driveways and so it is not a hardship on some residence they will be extending the compliance date to November 2020. Trustee Beemsterboer is concern with adding language that would allow the residents to match hard surface to soft surface and some type of language should be added for this, he would like the language to also clarify the hard surfaces in regards to parking lots. Community Development Director Nelson will bring this back before the Mayor and Board of Trustees with the language changes and clarification on parking lot areas.
Community Development Director Nelson informs the Mayor and Board of Trustees that they have before them A Request For Approval Of Whitefeather Unit 2B Plat Of Subdivision. McDonnell Development is seeking Final Plat Approval for Unit 2B, of the Whitefeather Subdivision. This unit consists of 14 Single-Family Units and will an extension of Mohawk Trail. There will be an outlet for a bike path extension into the Round Barn Farm. Detention is provided in the existing platted areas. The Planning and Zoning Commission has recommend approval.

Village Clerk Becker informs the Mayor and Board of Trustees that the last car show of the season had wonderful weather, new cars and was a great success.
