City of Lockport Planning & Zoning Commission met Sept. 11.

Here is the minutes provided by the commission:

The Regular Plan and Zoning Commission Meeting was held on Tuesday, September

11, 2018 in the Board Room, 3rd Floor, of the Central Square Building.

Chairman Oxley called the Meeting to order at 7:00 p.m. and led the Pledge of

Allegiance.

Commissioner Likins gave previous notification that he would not be present at the Meeting tonight.

APPROVAL OF AUGUST 14, 2018 MEETING MINUTES

MOTION BY MOLONY, SECOND BY PINN TO APPROVE THE AUGUST 14, 2018 PLAN AND ZONING COMMISSION MEETING MINUTES AS PRESENTED.

ALL VOTED AYE – MOTION CARRIED

Commissioner Oxley announced that there is a clerical error on the Agenda and there will be a Public Hearing held tonight on the Development Plan for an existing Commercial Bank.

MOTION BY MOLONY, SECOND BY SHEPARD TO OPEN THE PUBLIC HEARING AT 7:05 P.M.

15645 W. 159th Street/Final Development Plan for Renovation of an existing Commercial Bank Building and Special Use Permit for a Drive-Up Facility (Arby’s Restaurant)

City Planner, Kimberly Phillips, presented the Staff Report on the subject property.

The Applicant, John Theodosakis, on behalf of Lockport Retail Investors, LLC is seeking approval of a Final Development Plan for the renovation of an existing Commercial Bank Building and Special Use Permit for a Restaurant Drive-Up Facility. The property is located at 15645 W. 159th Street (the former Standard Bank property).

The Applicant intends to renovate the existing stand-alone Commercial Bank Building into two (2) tenant building to include a new drive-up facility. The parcel was originally part of the Lockport Center Development and later sold for the construction of the Standard Bank Building (constructed in 2005 with a drive-up facility) which operated until 2016.

Although the building still has the original drive-up window and canopy, the “use” of a drive-up has not occurred in over two years (the original Special Use has expired). The existing drive-up facility, located on the west side, will be removed and a reconfigured lane/pick-up window will be relocated to the south and east sides of the building.

The Applicant intends to renovate the interior of the building into two separate tenant spaces having 1,522 sf and 2,250 sf. The larger unit, located on the east side, will accommodate an Arby’s Restaurant with a drive-thru. A user for the smaller unit is unknown at this time. Arby’s desires to have the modifications completed by early December.

The subject property is zoned C-3 Highway Commercial. A drive-up facility is a Special Use within the C-3 Zoning District. Per the Zoning Ordinance, a drive-up facility is subject to the Special Use procedures and compliance with the standards in Section 156.122, and additional standards and criteria in Section 156.123C.

City Planner, Kimberly Phillips went through the project overview and Staff analysis with the Commissioners.

John Theodosakis, the Applicant, 954 1st Street, Highland Park, IL was present to answer any questions or concerns, along with the Architect. Mr. Theodosakis stated they will be addressing the few minor exceptions that Kimberly had mentioned within the next few days.

Chairman Oxley opened the Public Hearing for Public comment.

Hearing no comments from the Public, Chairman Oxley closed the Public Hearing at 7:21 p.m.

MOTION BY PORFILIO, SECOND BY PINN TO CLOSE THE PUBLIC HEARING AT 7:21 P.M.

ALL VOTED AYE – MOTION CARRIED

Commissioner Shepard stated when you come up to this bank and come up 159th Street and enter in, the island is planted with stuff and it has very bad visibility. Plants are 5 to 6 feet tall and you cannot see other cars coming in. That was his only issue.

Commissioner Porfilio stated the transformer sitting outside the building is not protected and would like to see some protection put there. To the east he would like to see speed bumps installed to slow down the traffic.

MOTION BY PORFILIO, SECOND BY SHEPARD TO APPROVE THE SPECIAL USE PERMIT FOR A DRIVE UP FACILITY AND TO APPROVE THE FINAL DEVELOPMENT PLAN AS PRESENTED WITH ADOPTING THE FINDINGS OF FACTS AS OUTLINED IN STAFF RECOMMENDATION.

OLD BUSINESS:

Director of Community and Economic Development, Pam Hirth announced the City has a Bike and Pedestrian Master Plan. This was created in 2003. There has been a lot of discussion amongst the Council encouraging bike paths. The current plan is old and the City recently entered into a Contract with Greenberg Farrow to update the Bike and Pedestrian Master Plan. The kick-off Meeting was today. We have to establish internal review and external review groups. Pam felt it would be very appropriate if a Member or two from the Plan and Zoning Commission be a part of that group. She is asking if anyone on the Commission would be interested in this. Commissioner Porfilio, Commissioner Pinn, and Commissioner Wheeler would like to be a part of this group.
