No closed session occurred on March 9, 2017.

U. Comments by Public Mr. Michael Brenczewski addressed the Board regarding hunting activities at Book Road/Riverview Farmstead. Brenczewski stated that he has been using Book Road to gain access to a parcel where he has been given the right to hunt the parcel by its owners, the Bronk's. A portion of the DuPage River borders this property. The Forest Preserve requested the issuance of a special use permit.

Brenczewski expressed his concerns with the special use permit. No one knows how long Suzanne Hart and Ralph Schultz will be with the Forest Preserve and he wanted to have some type of certainty for the future. Brenczewski stated that the annexation agreement was never filed by the City of Naperville.

Attorney Kavanagh stated that Attorney Kopman has spoken with Mr. Brenczewski in the past. Attorney Kavanagh will review and report back to the Operations Committee.

Chief Operating Officer Schultz stated that the Forest Preserve would waive the $50 fee for the special use permit in this case. The term would be for one year. In this case, three areas of the General Use Ordinance would be in violation:

Chapter I, Section 2 - Hours of Use Chapter II, Section 2 - Destruction or Misuse of Natural Resources Chapter V, Section 6 - Weapons and Harmful Substances

Commissioner Moustis expressed concern that Mr. Brenczewski had a prior right. Moustis asked if the District took away this right. Moustis stated that Brenczewski probably does not need a special use permit. Moustis asked if the Forest Preserve was aware in 2004 that Mr. Brenczewski was accessing the road.

Chief Operating Officer Schultz stated that the Forest Preserve was aware since 2008.

Chief Operating Officer Schultz stated that the current preserve was assembled over a 20 year period between 1994-2014. The preserve is 374.5 acres and stretches 2 miles along the DuPage River in Naperville and Plainfield. The parcel abutting the Bronk property is 27.89 acres and was donated to the Forest Preserve by the Macom Corporation. The area where Book Road bends to the west is where the road comes into Forest Preserve. The property was annexed into the City of Naperville in 2001. The Forest Preserve agreed to accept the donation in 2005. The Forest Preserve took title to the property in 2006. Under the annexation agreement, the City was required to vacate a portion of Book Road within the parcel lying adjacent to the DuPage River.

Commissioner Bennefield stated that Mr. Brenczewski had access to this property previously so perhaps special use would not be good because it may prohibit him in the future.

Mr. Brenczewski stated that he does not discharge his firearm into the Forest Preserve. He would transport the firearm via an enclosed case in the vehicle. Apparently another group of hunters are in violation as they do not have a right to use the property. This group is illegally hunting.

Commissioner Kraulidis inquired about the number of complaints received about hunters shooting into Forest Preserve property.

Chief Operating Officer Schultz stated that the Forest Preserve has received complaints of hunting from the river. The Forest Preserve is in the process of addressing this matter.

Commissioner Moran inquired about the distance from the duck blind to the residential area.

Mr. Brenczewski responded approximately 600 yards.

Commissioner Traynere stated, "I would like to have the information from Attorney Kavanagh before we continue to debate."

Commissioner Moustis stated that it is important for the attorney and staff to know and understand the concerns of the Commissioners. This is a county-wide issue.

Chief Operating Officer Schultz stated that this situation is not unique to the Forest Preserve.

President Hart stated that the Forest Preserve wants to be legal and safe and allow Mr. Brenczewski access to the property.

V. Comments by Chief Operating Officer and Chief Financial Officer

W. Appointments/Comments by President

1. Recommendation to Hire - Full Time Police Officer

President Hart made a recommendation to hire Matthew Yates as a full-time police officer at a projected starting salary of $45,231.00.

Commissioner Moustis stated that this is a replacement hire.
